國務院:實現工程建設項目審批“四統一”

日前,國(guo)務院(yuan)辦(ban)公廳印(yin)發《關于全面(mian)開(kai)展工程(cheng)建設(she)項目(mu)審批制度改(gai)革的(de)實施(shi)意(yi)(yi)見(jian)(jian)》(以下(xia)簡稱《意(yi)(yi)見(jian)(jian)》)。


《意見》指出(chu),要(yao)以習近平(ping)新時代中國特色(se)社會主義思(si)想為指導(dao),堅持以人民為中心,牢固樹立新發展理念,以推進政(zheng)府(fu)治(zhi)理體系和治(zhi)理能力現(xian)代化為目標,以更好更快方便企業和群眾辦事為導(dao)向,加大轉變政(zheng)府(fu)職能和簡(jian)政(zheng)放權力度,全面開展工程(cheng)建設項(xiang)目審批制度改(gai)革(ge)。


《意見》提(ti)出,對工(gong)(gong)程(cheng)建(jian)設(she)項目(mu)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)制(zhi)度實施全(quan)流(liu)程(cheng)、全(quan)覆蓋改(gai)革(ge)。2019年上(shang)半年,全(quan)國(guo)(guo)工(gong)(gong)程(cheng)建(jian)設(she)項目(mu)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)時間壓縮至120個工(gong)(gong)作日(ri)以內,省(自治區(qu))和(he)(he)地級及以上(shang)城市初步建(jian)成工(gong)(gong)程(cheng)建(jian)設(she)項目(mu)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)制(zhi)度框架和(he)(he)信息數據平(ping)臺;到2019年底,工(gong)(gong)程(cheng)建(jian)設(she)項目(mu)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)管理系(xi)統(tong)與相(xiang)關系(xi)統(tong)平(ping)臺互(hu)聯互(hu)通;試點地區(qu)繼續深(shen)化改(gai)革(ge),加大(da)改(gai)革(ge)創(chuang)新力度,提(ti)高審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)效能。到2020年底,基本(ben)建(jian)成全(quan)國(guo)(guo)統(tong)一的工(gong)(gong)程(cheng)建(jian)設(she)項目(mu)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)和(he)(he)管理體(ti)系(xi)。


《意(yi)見》提出,要實現工程建設項(xiang)目審(shen)批“四統一”。


一(yi)是統(tong)一(yi)審(shen)(shen)批(pi)流(liu)程(cheng)。精簡審(shen)(shen)批(pi)環節,逐步(bu)形成全(quan)國(guo)統(tong)一(yi)的(de)審(shen)(shen)批(pi)事項清單(dan)。合(he)理劃分審(shen)(shen)批(pi)階(jie)段,每(mei)個(ge)審(shen)(shen)批(pi)階(jie)段實行(xing)“一(yi)家牽頭(tou)、并聯(lian)(lian)審(shen)(shen)批(pi)、限時辦結(jie)”。制定全(quan)國(guo)統(tong)一(yi)的(de)工程(cheng)建設項目(mu)審(shen)(shen)批(pi)流(liu)程(cheng)圖示范文本,地(di)方進(jin)一(yi)步(bu)細化審(shen)(shen)批(pi)流(liu)程(cheng)。實行(xing)聯(lian)(lian)合(he)審(shen)(shen)圖和(he)聯(lian)(lian)合(he)驗收,推行(xing)區域評估和(he)告知承(cheng)諾制。


二是(shi)統(tong)一(yi)信息數(shu)據平臺。地級及以上(shang)地方人民(min)政(zheng)府要(yao)按(an)照“橫向(xiang)到邊(bian)、縱向(xiang)到底”的(de)原(yuan)則,整合(he)建(jian)(jian)(jian)設覆蓋地方各有關部門和區、縣的(de)工(gong)程(cheng)建(jian)(jian)(jian)設項目審批管理系統(tong),與(yu)國家相(xiang)關系統(tong)對接。省級工(gong)程(cheng)建(jian)(jian)(jian)設項目審批管理系統(tong)要(yao)與(yu)國家和本(ben)地區各城市(shi)相(xiang)關系統(tong)實現審批數(shu)據實時共(gong)享(xiang)。


三是統(tong)一審(shen)批(pi)管(guan)理體(ti)系。整合(he)各(ge)(ge)類規(gui)劃,構建(jian)(jian)(jian)“多規(gui)合(he)一”的“一張藍(lan)圖”,統(tong)籌(chou)項目實施。設立(li)工程建(jian)(jian)(jian)設項目審(shen)批(pi)綜(zong)(zong)合(he)服務(wu)窗(chuang)口,實現“一個窗(chuang)口”提供綜(zong)(zong)合(he)服務(wu)。各(ge)(ge)審(shen)批(pi)階段實行“一份辦事指(zhi)南,一張申請表單(dan),一套申報材料(liao),完成多項審(shen)批(pi)”的運(yun)作模式,整合(he)申報材料(liao)。建(jian)(jian)(jian)立(li)健全審(shen)批(pi)配(pei)套制度,“一套機制”規(gui)范審(shen)批(pi)運(yun)行。


四是統(tong)一監(jian)管(guan)(guan)方式。建立以(yi)“雙隨機(ji)、一公(gong)開”監(jian)管(guan)(guan)為基本手(shou)段,以(yi)重點監(jian)管(guan)(guan)為補充,以(yi)信用監(jian)管(guan)(guan)為基礎的新型監(jian)管(guan)(guan)機(ji)制(zhi)。加強(qiang)信用體系(xi)建設,構(gou)建“一處(chu)(chu)(chu)失信、處(chu)(chu)(chu)處(chu)(chu)(chu)受限”的聯(lian)合(he)懲戒(jie)機(ji)制(zhi)。建立健全中(zhong)介(jie)服(fu)務(wu)和市(shi)政公(gong)用服(fu)務(wu)管(guan)(guan)理(li)制(zhi)度,規(gui)范中(zhong)介(jie)和市(shi)政公(gong)用服(fu)務(wu)。


《意見(jian)》要(yao)求,各有(you)關部(bu)門要(yao)加強協(xie)作、密切配(pei)合(he)。各地方人民政(zheng)府要(yao)承(cheng)擔改(gai)革(ge)主體責(ze)任,制(zhi)定(ding)改(gai)革(ge)時(shi)間表、路線(xian)圖,確保(bao)按時(shi)保(bao)質完成改(gai)革(ge)任務。對于工作推進不力、影響工程建(jian)設項目審批制(zhi)度改(gai)革(ge)進程,特別是(shi)未(wei)按時(shi)完成階段性(xing)工作目標的(de),要(yao)依法依規嚴肅問責(ze)。

各省、自治(zhi)區(qu)、直(zhi)轄(xia)市(shi)人民政(zheng)府,國(guo)務院各部委、各直(zhi)屬機構:


工程(cheng)建設(she)項目審(shen)(shen)批(pi)(pi)(pi)(pi)制度(du)改(gai)革是黨(dang)中央、國(guo)(guo)務院在新形勢(shi)下(xia)作出的(de)重大決(jue)策,是推進政府職能轉變(bian)和深化“放管服”改(gai)革、優化營商環(huan)境的(de)重要內容。2018年5月工程(cheng)建設(she)項目審(shen)(shen)批(pi)(pi)(pi)(pi)制度(du)改(gai)革試點開展以來,試點地區按照(zhao)國(guo)(guo)務院部署,對工程(cheng)建設(she)項目審(shen)(shen)批(pi)(pi)(pi)(pi)制度(du)實施了(le)全流(liu)程(cheng)、全覆(fu)蓋(gai)改(gai)革,基本形成統(tong)一的(de)審(shen)(shen)批(pi)(pi)(pi)(pi)流(liu)程(cheng)、統(tong)一的(de)信息(xi)數據平(ping)臺、統(tong)一的(de)審(shen)(shen)批(pi)(pi)(pi)(pi)管理(li)體系(xi)和統(tong)一的(de)監(jian)管方式。經國(guo)(guo)務院同(tong)意(yi),現就全面(mian)開展工程(cheng)建設(she)項目審(shen)(shen)批(pi)(pi)(pi)(pi)制度(du)改(gai)革提出以下(xia)意(yi)見。


一、總體要求


(一(yi)(yi)(yi)(yi))指導思(si)(si)想。以(yi)習近平新時代(dai)中國特色社會主義思(si)(si)想為(wei)指導,深入貫徹黨的十九(jiu)大(da)和十九(jiu)屆二中、三中全(quan)會精神,堅持以(yi)人民為(wei)中心,牢固樹(shu)立新發展理(li)念(nian),以(yi)推進(jin)政府(fu)治(zhi)理(li)體系和治(zhi)理(li)能(neng)力(li)現(xian)(xian)代(dai)化(hua)為(wei)目(mu)標,以(yi)更好更快方便企業和群眾辦(ban)事為(wei)導向,加大(da)轉變政府(fu)職(zhi)能(neng)和簡政放(fang)權力(li)度,全(quan)面開展工(gong)程建(jian)(jian)設項(xiang)目(mu)審(shen)批制度改革,統(tong)(tong)一(yi)(yi)(yi)(yi)審(shen)批流程,統(tong)(tong)一(yi)(yi)(yi)(yi)信息(xi)數據平臺(tai),統(tong)(tong)一(yi)(yi)(yi)(yi)審(shen)批管(guan)(guan)理(li)體系,統(tong)(tong)一(yi)(yi)(yi)(yi)監管(guan)(guan)方式(shi),實現(xian)(xian)工(gong)程建(jian)(jian)設項(xiang)目(mu)審(shen)批“四統(tong)(tong)一(yi)(yi)(yi)(yi)”。


(二)改(gai)(gai)革內容(rong)。對工(gong)(gong)程(cheng)建(jian)設(she)項目(mu)審批制度實施全(quan)流程(cheng)、全(quan)覆蓋(gai)改(gai)(gai)革。改(gai)(gai)革覆蓋(gai)工(gong)(gong)程(cheng)建(jian)設(she)項目(mu)審批全(quan)過程(cheng)(包括(kuo)從立(li)項到(dao)竣工(gong)(gong)驗收和(he)(he)公(gong)共設(she)施接入服務);主要(yao)是(shi)房(fang)屋建(jian)筑和(he)(he)城市(shi)基礎設(she)施等工(gong)(gong)程(cheng),不(bu)包括(kuo)特殊工(gong)(gong)程(cheng)和(he)(he)交通、水(shui)利、能源等領域的重大工(gong)(gong)程(cheng);覆蓋(gai)行(xing)政(zheng)許可(ke)等審批事(shi)項和(he)(he)技術審查、中介服務、市(shi)政(zheng)公(gong)用(yong)服務以及備案等其他類型事(shi)項,推動流程(cheng)優化(hua)和(he)(he)標準化(hua)。


(三(san))主(zhu)要目(mu)標。2019年上半年,全國工程(cheng)建(jian)設項(xiang)(xiang)目(mu)審(shen)(shen)批(pi)時間(jian)(jian)壓縮至(zhi)120個工作日以內(nei),省(自(zi)治區)和地級及以上城市初步建(jian)成工程(cheng)建(jian)設項(xiang)(xiang)目(mu)審(shen)(shen)批(pi)制度框架和信息(xi)數據平(ping)臺;到(dao)2019年底(di),工程(cheng)建(jian)設項(xiang)(xiang)目(mu)審(shen)(shen)批(pi)管理(li)系統(tong)與(yu)相關系統(tong)平(ping)臺互(hu)聯互(hu)通(tong);試點地區繼續深(shen)化改革,加大改革創新力(li)度,進一(yi)步精簡審(shen)(shen)批(pi)環節和事(shi)項(xiang)(xiang),減少(shao)審(shen)(shen)批(pi)階段,壓減審(shen)(shen)批(pi)時間(jian)(jian),加強輔導服(fu)務,提高審(shen)(shen)批(pi)效能。到(dao)2020年底(di),基本建(jian)成全國統(tong)一(yi)的工程(cheng)建(jian)設項(xiang)(xiang)目(mu)審(shen)(shen)批(pi)和管理(li)體(ti)系。


二、統一審批流程


(四)精簡審(shen)(shen)(shen)批環(huan)節。精減審(shen)(shen)(shen)批事(shi)(shi)(shi)項(xiang)(xiang)和條(tiao)件,取消(xiao)不合(he)法、不合(he)理、不必要的審(shen)(shen)(shen)批事(shi)(shi)(shi)項(xiang)(xiang),減少保留事(shi)(shi)(shi)項(xiang)(xiang)的前(qian)(qian)置條(tiao)件。下放審(shen)(shen)(shen)批權限,按照方便企業和群眾辦(ban)(ban)事(shi)(shi)(shi)的原則,對(dui)(dui)下級機關(guan)有能(neng)力(li)(li)承接的審(shen)(shen)(shen)批事(shi)(shi)(shi)項(xiang)(xiang),下放或委托下級機關(guan)審(shen)(shen)(shen)批。合(he)并(bing)審(shen)(shen)(shen)批事(shi)(shi)(shi)項(xiang)(xiang),對(dui)(dui)由同一部(bu)門實施(shi)(shi)(shi)的管理內容相近或者屬于同一辦(ban)(ban)理階(jie)段的多個審(shen)(shen)(shen)批事(shi)(shi)(shi)項(xiang)(xiang),整(zheng)合(he)為一個審(shen)(shen)(shen)批事(shi)(shi)(shi)項(xiang)(xiang)。轉變管理方式,對(dui)(dui)能(neng)夠用征求(qiu)相關(guan)部(bu)門意見方式替代的審(shen)(shen)(shen)批事(shi)(shi)(shi)項(xiang)(xiang),調(diao)(diao)整(zheng)為政府內部(bu)協(xie)作(zuo)(zuo)事(shi)(shi)(shi)項(xiang)(xiang)。調(diao)(diao)整(zheng)審(shen)(shen)(shen)批時(shi)序,地(di)(di)(di)震安全性評價在(zai)工程(cheng)設計前(qian)(qian)完(wan)成(cheng)即可,環(huan)境影響評價、節能(neng)評價等評估(gu)評價和取水許可等事(shi)(shi)(shi)項(xiang)(xiang)在(zai)開(kai)(kai)工前(qian)(qian)完(wan)成(cheng)即可;可以將用地(di)(di)(di)預審(shen)(shen)(shen)意見作(zuo)(zuo)為使用土地(di)(di)(di)證明文(wen)件申請辦(ban)(ban)理建設工程(cheng)規劃許可證;將供水、供電、燃氣、熱力(li)(li)、排水、通信(xin)等市政公用基(ji)礎(chu)設施(shi)(shi)(shi)報裝提前(qian)(qian)到開(kai)(kai)工前(qian)(qian)辦(ban)(ban)理,在(zai)工程(cheng)施(shi)(shi)(shi)工階(jie)段完(wan)成(cheng)相關(guan)設施(shi)(shi)(shi)建設,竣(jun)工驗收后直(zhi)接辦(ban)(ban)理接入(ru)事(shi)(shi)(shi)宜。試點地(di)(di)(di)區要進(jin)一步精簡審(shen)(shen)(shen)批環(huan)節,在(zai)加快探(tan)索(suo)取消(xiao)施(shi)(shi)(shi)工圖審(shen)(shen)(shen)查(或縮小(xiao)審(shen)(shen)(shen)查范圍(wei))、實行告知(zhi)承諾(nuo)制(zhi)和設計人員終身負責制(zhi)等方面(mian),盡快形成(cheng)可復制(zhi)可推廣的經驗。


(五(wu))規范審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)。各(ge)地要(yao)按(an)照國(guo)務院統(tong)一(yi)要(yao)求(qiu),對本地區(qu)工程建設(she)項(xiang)(xiang)目審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)進(jin)行(xing)全(quan)面清(qing)(qing)理,統(tong)一(yi)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)和(he)法律依據(ju),逐(zhu)步形成全(quan)國(guo)統(tong)一(yi)的(de)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)名稱、申請材料和(he)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)時限(xian)。要(yao)本著合法、精簡(jian)、效能的(de)原則,制定國(guo)家(jia)、省(自治區(qu))和(he)地級(ji)及以上(shang)城市工程建設(she)項(xiang)(xiang)目審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)清(qing)(qing)單(dan),明確(que)各(ge)項(xiang)(xiang)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)的(de)適用范圍(wei)和(he)前(qian)置條件,并(bing)實行(xing)動(dong)態管理。下級(ji)政府(fu)制定的(de)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)清(qing)(qing)單(dan)原則上(shang)要(yao)與上(shang)級(ji)政府(fu)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)清(qing)(qing)單(dan)一(yi)致,超(chao)出上(shang)級(ji)政府(fu)審(shen)(shen)(shen)(shen)(shen)批(pi)(pi)(pi)(pi)(pi)事(shi)(shi)項(xiang)(xiang)清(qing)(qing)單(dan)范圍(wei)的(de),要(yao)報上(shang)級(ji)機關(guan)備案,并(bing)說明理由。


(六)合理劃分審批(pi)階(jie)(jie)(jie)段(duan)(duan)(duan)。將工程(cheng)(cheng)建設項目審批(pi)流程(cheng)(cheng)主(zhu)(zhu)(zhu)(zhu)要(yao)(yao)(yao)劃分為立項用(yong)地(di)(di)規(gui)劃許(xu)(xu)(xu)可(ke)(ke)、工程(cheng)(cheng)建設許(xu)(xu)(xu)可(ke)(ke)、施工許(xu)(xu)(xu)可(ke)(ke)、竣工驗收(shou)四個階(jie)(jie)(jie)段(duan)(duan)(duan)。其中,立項用(yong)地(di)(di)規(gui)劃許(xu)(xu)(xu)可(ke)(ke)階(jie)(jie)(jie)段(duan)(duan)(duan)主(zhu)(zhu)(zhu)(zhu)要(yao)(yao)(yao)包括(kuo)項目審批(pi)核(he)(he)(he)準、選(xuan)址意見書核(he)(he)(he)發、用(yong)地(di)(di)預審、用(yong)地(di)(di)規(gui)劃許(xu)(xu)(xu)可(ke)(ke)證(zheng)核(he)(he)(he)發等(deng)。工程(cheng)(cheng)建設許(xu)(xu)(xu)可(ke)(ke)階(jie)(jie)(jie)段(duan)(duan)(duan)主(zhu)(zhu)(zhu)(zhu)要(yao)(yao)(yao)包括(kuo)設計方(fang)案(an)(an)審查、建設工程(cheng)(cheng)規(gui)劃許(xu)(xu)(xu)可(ke)(ke)證(zheng)核(he)(he)(he)發等(deng)。施工許(xu)(xu)(xu)可(ke)(ke)階(jie)(jie)(jie)段(duan)(duan)(duan)主(zhu)(zhu)(zhu)(zhu)要(yao)(yao)(yao)包括(kuo)設計審核(he)(he)(he)確(que)認、施工許(xu)(xu)(xu)可(ke)(ke)證(zheng)核(he)(he)(he)發等(deng)。竣工驗收(shou)階(jie)(jie)(jie)段(duan)(duan)(duan)主(zhu)(zhu)(zhu)(zhu)要(yao)(yao)(yao)包括(kuo)規(gui)劃、土地(di)(di)、消(xiao)防(fang)、人防(fang)、檔案(an)(an)等(deng)驗收(shou)及竣工驗收(shou)備案(an)(an)等(deng)。其他(ta)行(xing)政許(xu)(xu)(xu)可(ke)(ke)、強制性(xing)評估(gu)、中介服務、市(shi)政公用(yong)服務以及備案(an)(an)等(deng)事項納(na)入相關階(jie)(jie)(jie)段(duan)(duan)(duan)辦理或與相關階(jie)(jie)(jie)段(duan)(duan)(duan)并(bing)(bing)行(xing)推進。每個審批(pi)階(jie)(jie)(jie)段(duan)(duan)(duan)確(que)定(ding)一(yi)(yi)家牽頭部(bu)門,實行(xing)“一(yi)(yi)家牽頭、并(bing)(bing)聯審批(pi)、限(xian)(xian)時(shi)辦結”,由(you)牽頭部(bu)門組織協調相關部(bu)門嚴格按照(zhao)限(xian)(xian)定(ding)時(shi)間完成審批(pi)。


(七)分類制(zhi)定審批流(liu)程(cheng)。制(zhi)定全國統一(yi)(yi)的工(gong)(gong)程(cheng)建(jian)設(she)(she)(she)項(xiang)(xiang)目(mu)審批流(liu)程(cheng)圖示范(fan)文(wen)本。地(di)級及以(yi)上地(di)方(fang)(fang)人(ren)民政(zheng)府要(yao)根據示范(fan)文(wen)本,分別制(zhi)定政(zheng)府投資、社會投資等不(bu)(bu)同類型(xing)(xing)工(gong)(gong)程(cheng)的審批流(liu)程(cheng)圖;同時可(ke)(ke)結合(he)實際,根據工(gong)(gong)程(cheng)建(jian)設(she)(she)(she)項(xiang)(xiang)目(mu)類型(xing)(xing)、投資類別、規模大小(xiao)等,進一(yi)(yi)步梳理(li)合(he)并審批流(liu)程(cheng)。簡化社會投資的中(zhong)小(xiao)型(xing)(xing)工(gong)(gong)程(cheng)建(jian)設(she)(she)(she)項(xiang)(xiang)目(mu)審批,對于帶(dai)方(fang)(fang)案出(chu)讓土地(di)的項(xiang)(xiang)目(mu),不(bu)(bu)再對設(she)(she)(she)計(ji)方(fang)(fang)案進行審核(he),將工(gong)(gong)程(cheng)建(jian)設(she)(she)(she)許可(ke)(ke)和(he)施工(gong)(gong)許可(ke)(ke)合(he)并為一(yi)(yi)個階(jie)段(duan)。試點地(di)區要(yao)進一(yi)(yi)步加大改革力度(du),也(ye)可(ke)(ke)以(yi)在其他工(gong)(gong)程(cheng)建(jian)設(she)(she)(she)項(xiang)(xiang)目(mu)中(zhong)探索將工(gong)(gong)程(cheng)建(jian)設(she)(she)(she)許可(ke)(ke)和(he)施工(gong)(gong)許可(ke)(ke)合(he)并為一(yi)(yi)個階(jie)段(duan)。


(八(ba))實(shi)行聯(lian)(lian)合審(shen)圖和(he)(he)聯(lian)(lian)合驗收(shou)。制定施工圖設計(ji)文(wen)件聯(lian)(lian)合審(shen)查(cha)和(he)(he)聯(lian)(lian)合竣工驗收(shou)管理辦(ban)法(fa)。將消防(fang)、人防(fang)、技防(fang)等技術審(shen)查(cha)并(bing)入施工圖設計(ji)文(wen)件審(shen)查(cha),相關部(bu)門(men)不(bu)再進行技術審(shen)查(cha)。實(shi)行規劃、土地、消防(fang)、人防(fang)、檔案等事項限(xian)時聯(lian)(lian)合驗收(shou),統一(yi)竣工驗收(shou)圖紙和(he)(he)驗收(shou)標(biao)準,統一(yi)出(chu)具驗收(shou)意(yi)見。對于驗收(shou)涉及(ji)的測繪工作,實(shi)行“一(yi)次委托、聯(lian)(lian)合測繪、成果共(gong)享”。


(九)推(tui)行區(qu)(qu)域(yu)(yu)評(ping)(ping)(ping)估。在(zai)各類開(kai)發區(qu)(qu)、工業園區(qu)(qu)、新區(qu)(qu)和其他(ta)有條(tiao)件的區(qu)(qu)域(yu)(yu),推(tui)行由政府統一(yi)組(zu)織對壓覆重要礦產(chan)資源、環(huan)境影響評(ping)(ping)(ping)價、節(jie)能評(ping)(ping)(ping)價、地(di)(di)質(zhi)災害危(wei)險性評(ping)(ping)(ping)估、地(di)(di)震安全性評(ping)(ping)(ping)價、水資源論證(zheng)等評(ping)(ping)(ping)估評(ping)(ping)(ping)價事項實行區(qu)(qu)域(yu)(yu)評(ping)(ping)(ping)估。實行區(qu)(qu)域(yu)(yu)評(ping)(ping)(ping)估的,政府相關(guan)部門(men)應在(zai)土地(di)(di)出讓(rang)或劃撥前,告知建(jian)(jian)設單位相關(guan)建(jian)(jian)設要求。


(十)推行告(gao)(gao)(gao)知承(cheng)諾(nuo)制(zhi)。對通過(guo)事(shi)中事(shi)后監(jian)管(guan)能(neng)夠糾正不符合審(shen)批(pi)(pi)條件(jian)的行為且不會產生嚴重后果的審(shen)批(pi)(pi)事(shi)項,實(shi)(shi)行告(gao)(gao)(gao)知承(cheng)諾(nuo)制(zhi)。公布實(shi)(shi)行告(gao)(gao)(gao)知承(cheng)諾(nuo)制(zhi)的工程(cheng)建設(she)項目審(shen)批(pi)(pi)事(shi)項清單(dan)及具體要求(qiu),申請(qing)人按照要求(qiu)作(zuo)(zuo)出書面(mian)承(cheng)諾(nuo)的,審(shen)批(pi)(pi)部(bu)門可以(yi)根據申請(qing)人信用等(deng)情況直接(jie)作(zuo)(zuo)出審(shen)批(pi)(pi)決定。對已經實(shi)(shi)施(shi)區域評估范圍內(nei)的工程(cheng)建設(she)項目,相(xiang)應(ying)的審(shen)批(pi)(pi)事(shi)項實(shi)(shi)行告(gao)(gao)(gao)知承(cheng)諾(nuo)制(zhi)。


三、統一信息數據平臺

四、統一審批管理體系


(十二)“一張(zhang)藍(lan)圖(tu)”統籌項(xiang)(xiang)(xiang)目(mu)實(shi)(shi)施。統籌整合(he)各類規(gui)劃(hua),劃(hua)定各類控制線,構(gou)建(jian)(jian)(jian)“多規(gui)合(he)一”的“一張(zhang)藍(lan)圖(tu)”。依托(tuo)工(gong)程建(jian)(jian)(jian)設項(xiang)(xiang)(xiang)目(mu)審(shen)批管理系統,加(jia)強“多規(gui)合(he)一”業務協同,統籌協調各部門對工(gong)程建(jian)(jian)(jian)設項(xiang)(xiang)(xiang)目(mu)提出建(jian)(jian)(jian)設條(tiao)件(jian)以及需要開(kai)展的評估評價事項(xiang)(xiang)(xiang)等要求,為項(xiang)(xiang)(xiang)目(mu)建(jian)(jian)(jian)設單位落實(shi)(shi)建(jian)(jian)(jian)設條(tiao)件(jian)、相(xiang)關部門加(jia)強監督管理提供依據(ju),加(jia)速項(xiang)(xiang)(xiang)目(mu)前期策劃(hua)生成,簡化項(xiang)(xiang)(xiang)目(mu)審(shen)批或核(he)準手續。


(十三)“一個窗(chuang)口(kou)(kou)(kou)”提(ti)供(gong)綜合服(fu)務(wu)(wu)(wu)。縣級及以上城市人民(min)政府要加強政務(wu)(wu)(wu)大廳建(jian)設,發揮服(fu)務(wu)(wu)(wu)企業群(qun)眾(zhong)、監(jian)督協調(diao)審(shen)批的(de)作用。整(zheng)合各部(bu)門和(he)各市政公用單位分散設立(li)(li)的(de)服(fu)務(wu)(wu)(wu)窗(chuang)口(kou)(kou)(kou),設立(li)(li)工(gong)程(cheng)建(jian)設項(xiang)(xiang)(xiang)目(mu)審(shen)批綜合服(fu)務(wu)(wu)(wu)窗(chuang)口(kou)(kou)(kou)。建(jian)立(li)(li)完善“前臺(tai)受理、后臺(tai)審(shen)核”機制,綜合服(fu)務(wu)(wu)(wu)窗(chuang)口(kou)(kou)(kou)統一收件、出件,實現“一個窗(chuang)口(kou)(kou)(kou)”服(fu)務(wu)(wu)(wu)和(he)管理。省(sheng)級人民(min)政府要統一制定本地區“一窗(chuang)受理”的(de)工(gong)作規程(cheng)。鼓勵為申(shen)請人提(ti)供(gong)工(gong)程(cheng)建(jian)設項(xiang)(xiang)(xiang)目(mu)審(shen)批咨詢(xun)、指導、協調(diao)和(he)代辦等(deng)服(fu)務(wu)(wu)(wu),幫(bang)助企業了解審(shen)批要求,提(ti)供(gong)相關(guan)工(gong)程(cheng)建(jian)設項(xiang)(xiang)(xiang)目(mu)的(de)申(shen)請材(cai)料清單,提(ti)高申(shen)報通過率。


(十(shi)四)“一(yi)張(zhang)表單(dan)”整合申(shen)(shen)(shen)(shen)(shen)報材(cai)(cai)料。各審(shen)批(pi)階段(duan)均(jun)實(shi)行“一(yi)份(fen)辦(ban)事(shi)指(zhi)(zhi)南(nan),一(yi)張(zhang)申(shen)(shen)(shen)(shen)(shen)請(qing)(qing)表單(dan),一(yi)套(tao)申(shen)(shen)(shen)(shen)(shen)報材(cai)(cai)料,完(wan)成(cheng)多項(xiang)審(shen)批(pi)”的(de)運作模式,牽頭部門制定統(tong)一(yi)的(de)辦(ban)事(shi)指(zhi)(zhi)南(nan)和申(shen)(shen)(shen)(shen)(shen)報表格,每個審(shen)批(pi)階段(duan)申(shen)(shen)(shen)(shen)(shen)請(qing)(qing)人只需(xu)(xu)提交(jiao)(jiao)一(yi)套(tao)申(shen)(shen)(shen)(shen)(shen)報材(cai)(cai)料。建(jian)立完(wan)善(shan)審(shen)批(pi)清單(dan)服務機制,主動為申(shen)(shen)(shen)(shen)(shen)請(qing)(qing)人提供項(xiang)目需(xu)(xu)要審(shen)批(pi)的(de)事(shi)項(xiang)清單(dan)。不(bu)同審(shen)批(pi)階段(duan)的(de)審(shen)批(pi)部門應當共(gong)享申(shen)(shen)(shen)(shen)(shen)報材(cai)(cai)料,不(bu)得要求申(shen)(shen)(shen)(shen)(shen)請(qing)(qing)人重(zhong)復提交(jiao)(jiao)。


(十五)“一(yi)套(tao)機(ji)(ji)制”規(gui)范(fan)(fan)審批(pi)(pi)運行(xing)。建立(li)健全(quan)工(gong)程(cheng)建設(she)項(xiang)目審批(pi)(pi)配套(tao)制度(du)(du),明(ming)確部(bu)門(men)職責,明(ming)晰工(gong)作規(gui)程(cheng),規(gui)范(fan)(fan)審批(pi)(pi)行(xing)為,確保審批(pi)(pi)各(ge)階段、各(ge)環節無縫銜接。建立(li)審批(pi)(pi)協(xie)(xie)調機(ji)(ji)制,協(xie)(xie)調解決部(bu)門(men)意見分歧。建立(li)跟蹤(zong)督辦制度(du)(du),實時跟蹤(zong)審批(pi)(pi)辦理情況,對全(quan)過(guo)程(cheng)實施督辦。各(ge)級政(zheng)府部(bu)門(men)要主動加強與(yu)人大及(ji)司(si)法(fa)機(ji)(ji)構的溝(gou)通協(xie)(xie)調配合,加快法(fa)律法(fa)規(gui)、規(gui)范(fan)(fan)性文件和標準(zhun)規(gui)范(fan)(fan)的立(li)改廢(fei)釋工(gong)作,修改或廢(fei)止與(yu)工(gong)程(cheng)建設(she)項(xiang)目審批(pi)(pi)制度(du)(du)改革要求不(bu)相符的相關制度(du)(du),建立(li)依法(fa)推進改革的長效機(ji)(ji)制。


五、統一監管方式


(十六)加強事(shi)中(zhong)事(shi)后監(jian)(jian)(jian)管(guan)。進(jin)一(yi)步轉變監(jian)(jian)(jian)管(guan)理念(nian),完(wan)善事(shi)中(zhong)事(shi)后監(jian)(jian)(jian)管(guan)體系,統一(yi)規范事(shi)中(zhong)事(shi)后監(jian)(jian)(jian)管(guan)模式(shi),建立以(yi)“雙隨機(ji)、一(yi)公(gong)開”監(jian)(jian)(jian)管(guan)為(wei)(wei)基本手(shou)段,以(yi)重點監(jian)(jian)(jian)管(guan)為(wei)(wei)補(bu)充,以(yi)信用(yong)監(jian)(jian)(jian)管(guan)為(wei)(wei)基礎的(de)新(xin)型(xing)監(jian)(jian)(jian)管(guan)機(ji)制,嚴肅查處(chu)違法違規行為(wei)(wei)。對(dui)于實行告知承(cheng)(cheng)諾(nuo)制的(de)審(shen)(shen)批事(shi)項,審(shen)(shen)批部(bu)門(men)應當在規定時間內對(dui)承(cheng)(cheng)諾(nuo)人履行承(cheng)(cheng)諾(nuo)的(de)情況進(jin)行檢查,承(cheng)(cheng)諾(nuo)人未履行承(cheng)(cheng)諾(nuo)的(de),審(shen)(shen)批部(bu)門(men)要依法撤銷(xiao)行政審(shen)(shen)批決定并追究承(cheng)(cheng)諾(nuo)人的(de)相應責任。


(十七(qi))加(jia)強(qiang)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)體系(xi)(xi)建(jian)設(she)(she)。建(jian)立工程建(jian)設(she)(she)項目審(shen)(shen)批信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息平(ping)臺,完善申請(qing)人信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)記錄,建(jian)立紅黑名單制(zhi)度,實行信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)分(fen)級分(fen)類管(guan)理,出(chu)臺工程建(jian)設(she)(she)項目審(shen)(shen)批守信(xin)(xin)(xin)(xin)(xin)(xin)聯合(he)激勵(li)和(he)(he)失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)聯合(he)懲(cheng)戒合(he)作備忘錄,對失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)企業和(he)(he)從(cong)業人員進行嚴格監管(guan)。將企業和(he)(he)從(cong)業人員違法(fa)違規、不履(lv)行承諾的(de)失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)行為(wei)納入工程建(jian)設(she)(she)項目審(shen)(shen)批管(guan)理系(xi)(xi)統(tong),并與全(quan)國(guo)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息共(gong)享平(ping)臺互聯互通,加(jia)強(qiang)信(xin)(xin)(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)(xin)(xin)息共(gong)享,構(gou)建(jian)“一處(chu)失(shi)信(xin)(xin)(xin)(xin)(xin)(xin)、處(chu)處(chu)受限”的(de)聯合(he)懲(cheng)戒機制(zhi)。


(十八(ba))規范中(zhong)介和(he)市政(zheng)公用(yong)服務(wu)。建(jian)立健全中(zhong)介服務(wu)和(he)市政(zheng)公用(yong)服務(wu)管理制(zhi)度,實(shi)行(xing)服務(wu)承諾制(zhi),明確服務(wu)標準和(he)辦(ban)事流程(cheng),規范服務(wu)收費(fei)。依托工程(cheng)建(jian)設(she)項(xiang)目審批管理系統(tong)建(jian)立中(zhong)介服務(wu)網(wang)上交易平臺,對中(zhong)介服務(wu)行(xing)為實(shi)施(shi)(shi)全過程(cheng)監管。供水、供電、燃氣、熱力、排水、通信等市政(zheng)公用(yong)服務(wu)要全部入駐政(zheng)務(wu)服務(wu)大廳,實(shi)施(shi)(shi)統(tong)一規范管理,為建(jian)設(she)單位提供“一站式”服務(wu)。


六、加強組織實施


(十九)強(qiang)化(hua)組(zu)織(zhi)領(ling)導。住房(fang)城(cheng)鄉(xiang)(xiang)建(jian)(jian)設(she)(she)部(bu)要(yao)(yao)切實擔負(fu)(fu)起工(gong)(gong)程(cheng)建(jian)(jian)設(she)(she)項目(mu)(mu)審批(pi)制(zhi)度改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)工(gong)(gong)作(zuo)的(de)組(zu)織(zhi)協調和督(du)促(cu)指(zhi)導責任;各(ge)(ge)部(bu)門(men)要(yao)(yao)密(mi)切協調配合,加強(qiang)工(gong)(gong)程(cheng)建(jian)(jian)設(she)(she)項目(mu)(mu)審批(pi)制(zhi)度改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)、投資審批(pi)制(zhi)度改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)等“放(fang)管服”各(ge)(ge)項改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)任務(wu)的(de)協同聯(lian)動,形(xing)成改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)合力(li)。各(ge)(ge)省級(ji)人(ren)民政(zheng)府要(yao)(yao)按照本實施意見(jian)要(yao)(yao)求(qiu),全面領(ling)導本地區(qu)工(gong)(gong)程(cheng)建(jian)(jian)設(she)(she)項目(mu)(mu)審批(pi)制(zhi)度改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)工(gong)(gong)作(zuo),加強(qiang)統(tong)籌協調、指(zhi)導和督(du)促(cu),為改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)工(gong)(gong)作(zuo)提供組(zu)織(zhi)和經(jing)費保(bao)障,積極推動各(ge)(ge)項改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)措施落地。各(ge)(ge)省級(ji)人(ren)民政(zheng)府要(yao)(yao)在本實施意見(jian)印發后1個月內制(zhi)定具(ju)體實施方案,并報住房(fang)城(cheng)鄉(xiang)(xiang)建(jian)(jian)設(she)(she)部(bu)備案。各(ge)(ge)地方人(ren)民政(zheng)府要(yao)(yao)高度重(zhong)視工(gong)(gong)程(cheng)建(jian)(jian)設(she)(she)項目(mu)(mu)審批(pi)制(zhi)度改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)工(gong)(gong)作(zuo),承擔改(gai)(gai)(gai)(gai)革(ge)(ge)(ge)主體責任,成立以主要(yao)(yao)負(fu)(fu)責同志為組(zu)長的(de)領(ling)導小組(zu),明確責任部(bu)門(men),制(zhi)定時間表、路線圖,確保(bao)按時保(bao)質(zhi)完(wan)成任務(wu)。


(二十(shi))加強溝(gou)通(tong)反饋和培(pei)訓(xun)。住房城鄉建(jian)設部(bu)要建(jian)立(li)上(shang)下聯動的溝(gou)通(tong)反饋機制(zhi),及時了解地方(fang)(fang)工(gong)(gong)程建(jian)設項目審批(pi)制(zhi)度改革工(gong)(gong)作(zuo)情(qing)況,督(du)促指導(dao)地方(fang)(fang)研究解決改革中遇到的問(wen)題(ti)。各地要針(zhen)對重(zhong)點、難點問(wen)題(ti),采用集中培(pei)訓(xun)、網絡培(pei)訓(xun)和專題(ti)培(pei)訓(xun)等方(fang)(fang)式(shi),加強對各級領導(dao)干(gan)部(bu)、工(gong)(gong)作(zuo)人員和申請人的業(ye)務(wu)培(pei)訓(xun),對相關政策進行全面解讀和輔導(dao),提(ti)高(gao)改革能力和業(ye)務(wu)水平。


(二(er)十一)嚴(yan)格督促(cu)落實(shi)。住房城鄉建(jian)(jian)設(she)(she)部(bu)要(yao)(yao)(yao)會同(tong)相(xiang)關(guan)部(bu)門(men)建(jian)(jian)立(li)工(gong)(gong)程(cheng)建(jian)(jian)設(she)(she)項目(mu)審(shen)批制度改革評(ping)估評(ping)價機(ji)制,重點(dian)評(ping)估評(ping)價各(ge)地(di)全流(liu)程(cheng)、全覆蓋(gai)改革和統(tong)一審(shen)批流(liu)程(cheng)、統(tong)一信息數據平臺、統(tong)一審(shen)批管(guan)理體系、統(tong)一監管(guan)方(fang)式(shi)等情(qing)(qing)況(kuang)(kuang),并(bing)將(jiang)有(you)關(guan)情(qing)(qing)況(kuang)(kuang)報國務院。地(di)方(fang)各(ge)級(ji)人民(min)政府要(yao)(yao)(yao)加大對(dui)地(di)方(fang)有(you)關(guan)部(bu)門(men)工(gong)(gong)作(zuo)的督導力度,跟蹤改革任務落實(shi)情(qing)(qing)況(kuang)(kuang)。各(ge)省級(ji)人民(min)政府要(yao)(yao)(yao)定期(qi)向住房城鄉建(jian)(jian)設(she)(she)部(bu)報送工(gong)(gong)作(zuo)進展情(qing)(qing)況(kuang)(kuang)。對(dui)于工(gong)(gong)作(zuo)推進不力、影響工(gong)(gong)程(cheng)建(jian)(jian)設(she)(she)項目(mu)審(shen)批制度改革進程(cheng),特別是(shi)未按時完成階段性(xing)工(gong)(gong)作(zuo)目(mu)標(biao)的,要(yao)(yao)(yao)依法依規嚴(yan)肅問責。


(二十(shi)二)做(zuo)好宣傳引(yin)導。各地要(yao)通過多種形式及時(shi)(shi)宣傳報道相關工作措(cuo)施和取得的成效,加(jia)強輿論引(yin)導,增(zeng)進社(she)會公眾(zhong)(zhong)對工程(cheng)建設項目審批制度改革(ge)工作的了解和支持,及時(shi)(shi)回應群(qun)眾(zhong)(zhong)關切,為(wei)順利推進改革(ge)營造(zao)良好的輿論環境。
