CSPPLAZA光熱發電網訊:在12月24日舉行的(de)第十(shi)三屆全(quan)(quan)國人(ren)(ren)民代表大會常(chang)務(wu)委員會第十(shi)五次(ci)會議上,全(quan)(quan)國人(ren)(ren)大常(chang)委會副委員長丁仲禮就(jiu)全(quan)(quan)國人(ren)(ren)大常(chang)委會執法(fa)檢查(cha)(cha)組近期對《中(zhong)華(hua)人(ren)(ren)民共和國可再生(sheng)能源法(fa)》實施情況的(de)執法(fa)檢查(cha)(cha)做(zuo)了專(zhuan)項報告。
丁仲禮在報告中指出,我國法律第4章規定了支持可再生能源并網發電,建立可再生能源獨立電力系統,鼓勵生物質能、太陽能熱發電、太陽能熱水、農村地區可再生能源推廣和應用等內容。其中,太陽能熱發電已經初(chu)步(bu)形成具有自主(zhu)知識產權的產業鏈。
相較而言,我國太陽能非電熱利用則發展較緩慢。我國法律第16、17條明確國家鼓勵發展生物質燃氣和熱力、太陽能熱利用等。而實際工作中,各類型可再生能源之間發展不平衡,可再生能源非電應用明顯滯后于發電類項目,太陽能熱利用、地熱利用以及生(sheng)物質(zhi)燃料的發展(zhan)都(dou)較為緩(huan)慢(man)。
他(ta)表示,有企業反映(ying)(ying),可(ke)再生(sheng)能源(yuan)(yuan)非電應用(yong)政策支持(chi)和經濟激勵力度不(bu)足(zu),生(sheng)物質熱力、生(sheng)物燃(ran)氣(qi)、生(sheng)物柴(chai)油(you)等產品(pin)缺乏具體的支持(chi)政策,受特許經營限制,難(nan)以公平進(jin)入市場。生(sheng)物質能開發利用(yong)對于改(gai)善(shan)民生(sheng)、助力脫貧(pin)攻堅、保(bao)護生(sheng)態環(huan)境(jing)等具有更加直接的作用(yong),應統籌考慮其環(huan)保(bao)效益和社(she)會效益,加大財稅政策支持(chi)力度。另外,一些地方反映(ying)(ying)對可(ke)再生(sheng)能源(yuan)(yuan)用(yong)戶(hu)企業支持(chi)政策尚有不(bu)足(zu)。
今年8月至11月,全國人大常委(wei)會(hui)組(zu)織開展了可再生能源(yuan)法執(zhi)法檢查(cha),執(zhi)法檢查(cha)組(zu)由(you)沈躍躍、白瑪赤林(lin)和丁仲(zhong)禮副(fu)(fu)委(wei)員(yuan)(yuan)長任(ren)組(zu)長,環(huan)資(zi)委(wei)主任(ren)委(wei)員(yuan)(yuan)高(gao)虎城任(ren)副(fu)(fu)組(zu)長,成(cheng)員(yuan)(yuan)共21位,由(you)全國人大常委(wei)會(hui)委(wei)員(yuan)(yuan)、環(huan)資(zi)委(wei)委(wei)員(yuan)(yuan)和全國人大代表(biao)組(zu)成(cheng)。
檢(jian)查(cha)組先后(hou)聽取了國(guo)(guo)家能源(yuan)(yuan)局、國(guo)(guo)家發展(zhan)改革委(wei)(wei)、財政部、自然資源(yuan)(yuan)部、生態環境部等部門(men)和單位關于貫徹實施可再生能源(yuan)(yuan)法(fa)情(qing)況的匯報(bao),并組織3個小組先后(hou)赴(fu)6個省(自治區)的19個地市(shi)、51個檢(jian)查(cha)點開展(zhan)執(zhi)法(fa)檢(jian)查(cha)工作(zuo),還委(wei)(wei)托山西等12個省(自治區)人大常委(wei)(wei)會(hui)對本行(xing)政區域內實施情(qing)況進行(xing)檢(jian)查(cha),同時委(wei)(wei)托中國(guo)(guo)工程院組織近百位院士(shi)及專(zhuan)家深入評(ping)估(gu)形成第三方評(ping)估(gu)報(bao)告作(zuo)為此次執(zhi)法(fa)檢(jian)查(cha)的參考(kao)。

根據(ju)全(quan)國(guo)人大(da)(da)常(chang)(chang)(chang)委(wei)(wei)(wei)會(hui)(hui)2019年度監督(du)工作計劃(hua),今年8月(yue)至(zhi)(zhi)11月(yue)全(quan)國(guo)人大(da)(da)常(chang)(chang)(chang)委(wei)(wei)(wei)會(hui)(hui)組(zu)(zu)織開(kai)展(zhan)了可再(zai)(zai)生能(neng)源(yuan)(yuan)(yuan)法(fa)(fa)(fa)(fa)(fa)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)檢(jian)(jian)查(cha)(cha)。執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)檢(jian)(jian)查(cha)(cha)組(zu)(zu)由(you)沈躍(yue)躍(yue)、白(bai)瑪赤林(lin)和(he)(he)丁仲禮副委(wei)(wei)(wei)員(yuan)(yuan)長(chang)(chang)任組(zu)(zu)長(chang)(chang),環資(zi)(zi)委(wei)(wei)(wei)主任委(wei)(wei)(wei)員(yuan)(yuan)高(gao)虎城任副組(zu)(zu)長(chang)(chang),成員(yuan)(yuan)共21位,由(you)全(quan)國(guo)人大(da)(da)常(chang)(chang)(chang)委(wei)(wei)(wei)會(hui)(hui)委(wei)(wei)(wei)員(yuan)(yuan)、環資(zi)(zi)委(wei)(wei)(wei)委(wei)(wei)(wei)員(yuan)(yuan)和(he)(he)全(quan)國(guo)人大(da)(da)代表組(zu)(zu)成。8月(yue)28日,檢(jian)(jian)查(cha)(cha)組(zu)(zu)召開(kai)第一次全(quan)體會(hui)(hui)議,聽取國(guo)家(jia)(jia)能(neng)源(yuan)(yuan)(yuan)局、國(guo)家(jia)(jia)發展(zhan)改革委(wei)(wei)(wei)、財政部(bu)(bu)、自然資(zi)(zi)源(yuan)(yuan)(yuan)部(bu)(bu)、生態環境部(bu)(bu)等(deng)部(bu)(bu)門和(he)(he)單位關于貫徹實施(shi)可再(zai)(zai)生能(neng)源(yuan)(yuan)(yuan)法(fa)(fa)(fa)(fa)(fa)情(qing)況(kuang)的匯報(bao)(bao),部(bu)(bu)署開(kai)展(zhan)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)檢(jian)(jian)查(cha)(cha)工作。8月(yue)至(zhi)(zhi)9月(yue),檢(jian)(jian)查(cha)(cha)組(zu)(zu)分3個(ge)小組(zu)(zu),赴河北、吉林(lin)、甘肅(su)、青海、寧夏、新(xin)疆(jiang)等(deng)6個(ge)省(sheng)(自治區(qu))開(kai)展(zhan)執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)檢(jian)(jian)查(cha)(cha)工作。檢(jian)(jian)查(cha)(cha)組(zu)(zu)深(shen)入(ru)到19個(ge)地(di)(di)市(shi),實地(di)(di)檢(jian)(jian)查(cha)(cha)51個(ge)點位,召開(kai)16個(ge)座(zuo)(zuo)談(tan)會(hui)(hui),與政府及有關部(bu)(bu)門、相關企業、基層執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)人員(yuan)(yuan)和(he)(he)五級人大(da)(da)代表座(zuo)(zuo)談(tan),聽取法(fa)(fa)(fa)(fa)(fa)律實施(shi)情(qing)況(kuang)及有關意(yi)見(jian)建議。同時,委(wei)(wei)(wei)托山西、內蒙古、黑龍江(jiang)、浙江(jiang)、山東(dong)、湖北、湖南、廣東(dong)、廣西、四(si)川、云南、西藏(zang)等(deng)12個(ge)省(sheng)(自治區(qu))人大(da)(da)常(chang)(chang)(chang)委(wei)(wei)(wei)會(hui)(hui)對(dui)本行(xing)政區(qu)域內可再(zai)(zai)生能(neng)源(yuan)(yuan)(yuan)法(fa)(fa)(fa)(fa)(fa)的實施(shi)情(qing)況(kuang)進(jin)行(xing)檢(jian)(jian)查(cha)(cha)。全(quan)國(guo)人大(da)(da)環資(zi)(zi)委(wei)(wei)(wei)還委(wei)(wei)(wei)托中國(guo)工程(cheng)院開(kai)展(zhan)了可再(zai)(zai)生能(neng)源(yuan)(yuan)(yuan)法(fa)(fa)(fa)(fa)(fa)實施(shi)情(qing)況(kuang)評估(gu)研究,14位兩院院士、70多位專家(jia)(jia)經(jing)過深(shen)入(ru)研究論證(zheng),形成了第三方評估(gu)報(bao)(bao)告,為執(zhi)(zhi)(zhi)法(fa)(fa)(fa)(fa)(fa)檢(jian)(jian)查(cha)(cha)提(ti)供了重要參考和(he)(he)支撐。
這(zhe)次(ci)執(zhi)(zhi)法檢(jian)(jian)查有(you)幾個突出(chu)特點:一是把(ba)宣(xuan)傳貫(guan)徹習(xi)(xi)近(jin)平(ping)生(sheng)(sheng)(sheng)態(tai)文明思(si)(si)想和黨中(zhong)央(yang)可(ke)再生(sheng)(sheng)(sheng)能(neng)源發(fa)展戰略貫(guan)穿于(yu)執(zhi)(zhi)法檢(jian)(jian)查全過程,聽取(qu)各地(di)(di)貫(guan)徹落(luo)(luo)實習(xi)(xi)近(jin)平(ping)生(sheng)(sheng)(sheng)態(tai)文明思(si)(si)想和習(xi)(xi)近(jin)平(ping)總書(shu)記重(zhong)要(yao)指示批示情(qing)況。二是認真貫(guan)徹落(luo)(luo)實栗戰書(shu)委員長對執(zhi)(zhi)法檢(jian)(jian)查的要(yao)求,緊扣法律(lv)(lv)(lv)制度規定開展檢(jian)(jian)查,堅持問題(ti)導向,依法推動解決可(ke)再生(sheng)(sheng)(sheng)能(neng)源開發(fa)利用存(cun)在(zai)的突出(chu)問題(ti)。三(san)是將(jiang)執(zhi)(zhi)法檢(jian)(jian)查與議案(an)建(jian)議辦理工(gong)作有(you)機(ji)結合(he),深(shen)入(ru)聽取(qu)人(ren)大代(dai)表(biao)意見(jian)建(jian)議。四是開展問卷(juan)調查,了解各地(di)(di)對法律(lv)(lv)(lv)的學習(xi)(xi)掌握情(qing)況,推動法律(lv)(lv)(lv)宣(xuan)傳普(pu)及,加強(qiang)(qiang)(qiang)法律(lv)(lv)(lv)學習(xi)(xi)貫(guan)徹。五是委托中(zhong)國工(gong)程院開展可(ke)再生(sheng)(sheng)(sheng)能(neng)源法實施(shi)情(qing)況評(ping)估(gu)研究,強(qiang)(qiang)(qiang)化專業(ye)支撐,增(zeng)強(qiang)(qiang)(qiang)監督工(gong)作的科學性和客觀性。六是廣泛深(shen)入(ru)聽取(qu)五級人(ren)大代(dai)表(biao)、政府部門、企業(ye)、專家(jia)對法律(lv)(lv)(lv)實施(shi)和修(xiu)改完善法律(lv)(lv)(lv)的意見(jian)建(jian)議。
下面,我代表執法檢查組,將可再(zai)生能源法執法檢查的主要情況(kuang)報告(gao)如下。
一、法律實施總體情況
黨(dang)的(de)(de)十(shi)八大以(yi)(yi)來,在(zai)黨(dang)中(zhong)(zhong)央(yang)堅(jian)強領導下,各(ge)地區各(ge)部(bu)門以(yi)(yi)習(xi)近平(ping)新時代中(zhong)(zhong)國特色社會主義(yi)思想(xiang)為指導,深入(ru)貫徹落實習(xi)近平(ping)生(sheng)態文明思想(xiang),認真(zhen)落實黨(dang)中(zhong)(zhong)央(yang)可(ke)(ke)(ke)(ke)(ke)再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)發(fa)(fa)(fa)展戰(zhan)略,認真(zhen)貫徹實施可(ke)(ke)(ke)(ke)(ke)再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)法,推(tui)(tui)動可(ke)(ke)(ke)(ke)(ke)再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)快速發(fa)(fa)(fa)展,為推(tui)(tui)進能(neng)(neng)(neng)源(yuan)(yuan)革命、保護(hu)生(sheng)態環境、促進經(jing)濟和社會可(ke)(ke)(ke)(ke)(ke)持續發(fa)(fa)(fa)展發(fa)(fa)(fa)揮著日益重要的(de)(de)作用。自(zi)2006年(nian)1月1日可(ke)(ke)(ke)(ke)(ke)再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)法頒(ban)布實施以(yi)(yi)來,可(ke)(ke)(ke)(ke)(ke)再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)開(kai)發(fa)(fa)(fa)利用規(gui)模顯著擴大,技術裝(zhuang)備水平(ping)不斷提升(sheng)。我(wo)國水電(dian)(dian)(dian)、風(feng)電(dian)(dian)(dian)、光(guang)伏發(fa)(fa)(fa)電(dian)(dian)(dian)的(de)(de)累計裝(zhuang)機規(gui)模均(jun)居(ju)世界首位。2018年(nian),全國可(ke)(ke)(ke)(ke)(ke)再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)發(fa)(fa)(fa)電(dian)(dian)(dian)量(liang)18670億(yi)千瓦時,占全部(bu)發(fa)(fa)(fa)電(dian)(dian)(dian)量(liang)的(de)(de)26.7%,比2005年(nian)提高(gao)10.6個百分點。其中(zhong)(zhong)非水可(ke)(ke)(ke)(ke)(ke)再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)總(zong)裝(zhuang)機容量(liang)是2005年(nian)的(de)(de)94倍,發(fa)(fa)(fa)電(dian)(dian)(dian)量(liang)是2005年(nian)的(de)(de)91倍。可(ke)(ke)(ke)(ke)(ke)再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)占一次能(neng)(neng)(neng)源(yuan)(yuan)消費總(zong)量(liang)比重達到(dao)12.5%左右,比2005年(nian)翻(fan)了一番。
可(ke)(ke)再(zai)(zai)生(sheng)(sheng)能源(yuan)(yuan)法(fa)(fa)主(zhu)要法(fa)(fa)律制度基(ji)本(ben)落(luo)實(shi),法(fa)(fa)律得到有(you)(you)效實(shi)施,基(ji)本(ben)實(shi)現了立法(fa)(fa)目(mu)的(de)。法(fa)(fa)律第(di)(di)(di)(di)4條規(gui)(gui)定(ding)的(de)總量目(mu)標(biao)制度有(you)(you)效落(luo)實(shi)。法(fa)(fa)律第(di)(di)(di)(di)2章(zhang)(zhang)關于資源(yuan)(yuan)調(diao)查(cha)與發(fa)展(zhan)規(gui)(gui)劃(hua)的(de)有(you)(you)關規(gui)(gui)定(ding)加快實(shi)施,開展(zhan)了資源(yuan)(yuan)調(diao)查(cha),編制了可(ke)(ke)再(zai)(zai)生(sheng)(sheng)能源(yuan)(yuan)開發(fa)利(li)(li)用(yong)規(gui)(gui)劃(hua)。按照法(fa)(fa)律第(di)(di)(di)(di)3章(zhang)(zhang)要求(qiu),公布了可(ke)(ke)再(zai)(zai)生(sheng)(sheng)能源(yuan)(yuan)產(chan)(chan)業發(fa)展(zhan)指(zhi)導(dao)目(mu)錄,制定(ding)了相關技(ji)(ji)術標(biao)準規(gui)(gui)范(fan),推動(dong)可(ke)(ke)再(zai)(zai)生(sheng)(sheng)能源(yuan)(yuan)技(ji)(ji)術水平顯(xian)著進(jin)步。第(di)(di)(di)(di)4章(zhang)(zhang)至第(di)(di)(di)(di)6章(zhang)(zhang)規(gui)(gui)定(ding)的(de)相關制度規(gui)(gui)定(ding)逐步落(luo)實(shi),可(ke)(ke)再(zai)(zai)生(sheng)(sheng)能源(yuan)(yuan)發(fa)電成本(ben)明顯(xian)下降,裝備制造產(chan)(chan)業快速發(fa)展(zhan),可(ke)(ke)再(zai)(zai)生(sheng)(sheng)能源(yuan)(yuan)開發(fa)利(li)(li)用(yong)水平快速提升,在拉動(dong)經濟增長、優化產(chan)(chan)業結構(gou)和擴大(da)(da)就業崗位(wei)、落(luo)實(shi)控制溫室氣體排放目(mu)標(biao)和治理大(da)(da)氣污染等方面發(fa)揮了重要作用(yong),為(wei)調(diao)整能源(yuan)(yuan)結構(gou)、實(shi)現綠色發(fa)展(zhan)做出了積極貢獻。但(dan)伴隨可(ke)(ke)再(zai)(zai)生(sheng)(sheng)能源(yuan)(yuan)產(chan)(chan)業快速發(fa)展(zhan),法(fa)(fa)律有(you)(you)關開發(fa)利(li)(li)用(yong)規(gui)(gui)劃(hua)、全額保障性(xing)收(shou)購(gou)、費用(yong)補償等部(bu)分(fen)法(fa)(fa)律制度,也存(cun)在統(tong)籌協(xie)調(diao)不夠、落(luo)實(shi)不到位(wei)、監管薄弱等問題,有(you)(you)待進(jin)一步研究解決。
二、法律實施成效
各地(di)區各部門按照(zhao)可再生能源法要(yao)求(qiu),依法履職(zhi)盡責(ze),積極出臺配套政(zheng)策,認真落實法律規(gui)定,法律實施取(qu)得了顯著成效。
(一)出臺配套法規制度,提升可再生能源發展法治化水平
國務院相關部門(men)高度(du)重視可(ke)再(zai)(zai)生(sheng)(sheng)能(neng)源(yuan)法(fa)的貫(guan)徹實(shi)施,依法(fa)在資(zi)源(yuan)調查(cha)、總量目(mu)標、規(gui)(gui)劃引導(dao)、應用示(shi)范、產業監測、并網(wang)消(xiao)納(na)等(deng)(deng)(deng)方面出(chu)(chu)臺(tai)(tai)了(le)上(shang)(shang)百項配套規(gui)(gui)章(zhang)政(zheng)(zheng)策(ce),規(gui)(gui)范了(le)可(ke)再(zai)(zai)生(sheng)(sheng)能(neng)源(yuan)發電(dian)(dian)(dian)上(shang)(shang)網(wang)管理(li)(li)有(you)關內容,明確了(le)上(shang)(shang)網(wang)電(dian)(dian)(dian)價和費用分攤(tan)制(zhi)(zhi)度(du),制(zhi)(zhi)定(ding)了(le)可(ke)再(zai)(zai)生(sheng)(sheng)能(neng)源(yuan)裝備設備、工程建設、并網(wang)運行等(deng)(deng)(deng)技術(shu)標準,為(wei)推動可(ke)再(zai)(zai)生(sheng)(sheng)能(neng)源(yuan)快速(su)發展營造了(le)良好的政(zheng)(zheng)策(ce)環境(jing)。各級地(di)(di)(di)方政(zheng)(zheng)府(fu)結合(he)本地(di)(di)(di)實(shi)際,制(zhi)(zhi)定(ding)出(chu)(chu)臺(tai)(tai)了(le)地(di)(di)(di)方性法(fa)規(gui)(gui)政(zheng)(zheng)策(ce),如(ru)河北(bei)、浙(zhe)江制(zhi)(zhi)定(ding)了(le)可(ke)再(zai)(zai)生(sheng)(sheng)能(neng)源(yuan)開發利用促進條例,黑龍(long)江、山東、湖北(bei)、湖南(nan)等(deng)(deng)(deng)省(sheng)(區(qu)、市)制(zhi)(zhi)定(ding)了(le)農村可(ke)再(zai)(zai)生(sheng)(sheng)能(neng)源(yuan)條例,吉林、廣西等(deng)(deng)(deng)省(sheng)(區(qu)、市)出(chu)(chu)臺(tai)(tai)了(le)水(shui)能(neng)資(zi)源(yuan)開發利用管理(li)(li)有(you)關規(gui)(gui)定(ding),內蒙(meng)古、四川、云南(nan)、寧夏等(deng)(deng)(deng)省(sheng)(區(qu)、市)出(chu)(chu)臺(tai)(tai)了(le)風能(neng)、太陽能(neng)、地(di)(di)(di)熱能(neng)等(deng)(deng)(deng)開發利用的有(you)關規(gui)(gui)定(ding),山西出(chu)(chu)臺(tai)(tai)了(le)可(ke)再(zai)(zai)生(sheng)(sheng)能(neng)源(yuan)發電(dian)(dian)(dian)全額保障性收購管理(li)(li)辦法(fa),各地(di)(di)(di)支持可(ke)再(zai)(zai)生(sheng)(sheng)能(neng)源(yuan)發展的配套法(fa)規(gui)(gui)和政(zheng)(zheng)策(ce)體系逐步完善(shan)。
(二)落實資源調查和規劃制度,引導可再生能源發展方向
法律第2章規(gui)(gui)定(ding)(ding)(ding)了(le)開展(zhan)(zhan)(zhan)可(ke)再(zai)(zai)(zai)(zai)生能(neng)(neng)源(yuan)(yuan)(yuan)資(zi)源(yuan)(yuan)(yuan)調查與(yu)編(bian)(bian)(bian)制(zhi)(zhi)(zhi)開發(fa)(fa)利(li)用規(gui)(gui)劃(hua)(hua)等(deng)(deng)內容。國(guo)務院有關部門(men)(men)依法組織開展(zhan)(zhan)(zhan)了(le)可(ke)再(zai)(zai)(zai)(zai)生能(neng)(neng)源(yuan)(yuan)(yuan)資(zi)源(yuan)(yuan)(yuan)詳查,于2008年(nian)和(he)(he)(he)2014年(nian)分別(bie)發(fa)(fa)布了(le)中國(guo)太陽(yang)能(neng)(neng)資(zi)源(yuan)(yuan)(yuan)圖譜和(he)(he)(he)全國(guo)風能(neng)(neng)評價成果(guo),為國(guo)家(jia)和(he)(he)(he)地(di)方(fang)開展(zhan)(zhan)(zhan)規(gui)(gui)劃(hua)(hua)編(bian)(bian)(bian)制(zhi)(zhi)(zhi)、企業開發(fa)(fa)項(xiang)目(mu)選(xuan)址提(ti)供了(le)基(ji)礎(chu)依據(ju)和(he)(he)(he)支撐(cheng)。在此基(ji)礎(chu)上,組織編(bian)(bian)(bian)制(zhi)(zhi)(zhi)了(le)國(guo)家(jia)“十一五(wu)(wu)”、“十二五(wu)(wu)”、“十三(san)五(wu)(wu)”可(ke)再(zai)(zai)(zai)(zai)生能(neng)(neng)源(yuan)(yuan)(yuan)發(fa)(fa)展(zhan)(zhan)(zhan)規(gui)(gui)劃(hua)(hua)以及水電、風電、太陽(yang)能(neng)(neng)、生物質能(neng)(neng)和(he)(he)(he)地(di)熱能(neng)(neng)領域(yu)五(wu)(wu)年(nian)規(gui)(gui)劃(hua)(hua)。甘肅等(deng)(deng)15個省(區(qu)、市(shi))編(bian)(bian)(bian)制(zhi)(zhi)(zhi)了(le)可(ke)再(zai)(zai)(zai)(zai)生能(neng)(neng)源(yuan)(yuan)(yuan)(或(huo)(huo)新能(neng)(neng)源(yuan)(yuan)(yuan))發(fa)(fa)展(zhan)(zhan)(zhan)“十三(san)五(wu)(wu)”規(gui)(gui)劃(hua)(hua);廣東、西藏(zang)等(deng)(deng)16個省(區(qu)、市(shi))在能(neng)(neng)源(yuan)(yuan)(yuan)發(fa)(fa)展(zhan)(zhan)(zhan)“十三(san)五(wu)(wu)”規(gui)(gui)劃(hua)(hua)或(huo)(huo)“十三(san)五(wu)(wu)”電力發(fa)(fa)展(zhan)(zhan)(zhan)規(gui)(gui)劃(hua)(hua)中規(gui)(gui)定(ding)(ding)(ding)了(le)可(ke)再(zai)(zai)(zai)(zai)生能(neng)(neng)源(yuan)(yuan)(yuan)發(fa)(fa)展(zhan)(zhan)(zhan)目(mu)標(biao);新疆等(deng)(deng)省(區(qu)、市(shi))還對部分可(ke)再(zai)(zai)(zai)(zai)生能(neng)(neng)源(yuan)(yuan)(yuan)品種專門(men)(men)制(zhi)(zhi)(zhi)定(ding)(ding)(ding)了(le)分項(xiang)發(fa)(fa)展(zhan)(zhan)(zhan)規(gui)(gui)劃(hua)(hua)。可(ke)再(zai)(zai)(zai)(zai)生能(neng)(neng)源(yuan)(yuan)(yuan)發(fa)(fa)展(zhan)(zhan)(zhan)規(gui)(gui)劃(hua)(hua)體(ti)系逐步建(jian)立(li),為引(yin)導可(ke)再(zai)(zai)(zai)(zai)生能(neng)(neng)源(yuan)(yuan)(yuan)發(fa)(fa)展(zhan)(zhan)(zhan)方(fang)向(xiang)、優化結構(gou)布局發(fa)(fa)揮了(le)重要作用。
(三)加強產業指導和技術創新,大力扶持可再生能源產業發展
法律第3章要求國務院相關部門加強對可再生能源產業指導和技術研發。國家能源局會同發展改革委發布了可再生能源產業發展指導目錄,為制定支持可再生能源發展財政、稅收等政策提供依據。可再生能源產業示范項目穩步推進,“十二五”期間實施81個新能源示范城市、8個新能源示范園區、86個綠色能源示范縣,“十三五”期間組織實施6個清潔能源示范省、4個可再生能源綜合應用示范區以及28個新能源微電網示范工程。2015年以來,組織開展3批光伏“領跑者”基地項目建設。這些示范項目在提升可再生能源消費比重,推動先進技術成果產業化,促進產業升級等方面取得積極效果。可再生能源法頒布實施后,科技部在國家科技計劃中優先部署可再生能源技術研發,截至“十二五”末期投入中央財政經費逾23億元。“十三五”期間投入中央財政資金7億元,實施“可再生能源與氫能技術”、“智能電網技術與裝備”兩個重點研發專項。通過創新驅動和國家科技計劃的實施,我國可再生能源領域科技創新能力及產業技術水平得到跨越式提升。水電作為傳統可再生能源,已經位于世界水電強國前列;光伏發電產業規模連續多年世界第一,是我國少數有話語權的行業之一,光伏發電技術在國際市場擁有絕對競爭優勢;風電領域建立了完整的設備制造產業鏈,風電開發規模穩居世界首位;太陽能熱發電初步形成具有(you)自主知識產權的(de)產業鏈;生(sheng)物質能實現了多元化技術(shu)發展(zhan)和應(ying)用(yong);地熱能實現了工程(cheng)規(gui)模化應(ying)用(yong);海洋能技術(shu)研究和應(ying)用(yong)示范不斷取得新進展(zhan);電網(wang)接入和運行(xing)技術(shu)水(shui)平(ping)不斷提高,為可再生(sheng)能源大規(gui)模發展(zhan)和消納提供有(you)力(li)支撐(cheng)。
(四)落實相關法律制度,提高可再生能源開發利用水平
法律第4章規定了支持可再生能源并網發電,建立可再生能源獨立電力系統,鼓勵生物質能、太陽能熱發電、太陽能(neng)(neng)(neng)(neng)(neng)(neng)熱(re)水、農村地區可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)推(tui)廣和(he)應用(yong)等內容。為(wei)(wei)落實全(quan)額(e)保(bao)障性收(shou)購(gou)制度(du)(du),國家(jia)(jia)發(fa)(fa)(fa)(fa)展(zhan)(zhan)改革(ge)(ge)委、能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)局(ju)出臺(tai)了(le)可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)發(fa)(fa)(fa)(fa)電(dian)(dian)(dian)(dian)(dian)全(quan)額(e)保(bao)障性收(shou)購(gou)管(guan)理辦法(fa)、清潔能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)消(xiao)納(na)(na)(na)行(xing)(xing)動計劃(hua)、建立健(jian)全(quan)可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)電(dian)(dian)(dian)(dian)(dian)力消(xiao)納(na)(na)(na)保(bao)障機(ji)制的(de)通知等政策文件,核定(ding)了(le)重點地區風(feng)(feng)電(dian)(dian)(dian)(dian)(dian)和(he)光(guang)伏(fu)最低(di)保(bao)障收(shou)購(gou)年利(li)用(yong)小時(shi)數,設(she)定(ding)了(le)各省級行(xing)(xing)政區可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)電(dian)(dian)(dian)(dian)(dian)力消(xiao)納(na)(na)(na)責任權重等。建立了(le)風(feng)(feng)電(dian)(dian)(dian)(dian)(dian)、光(guang)伏(fu)發(fa)(fa)(fa)(fa)電(dian)(dian)(dian)(dian)(dian)發(fa)(fa)(fa)(fa)展(zhan)(zhan)監測(ce)評價體(ti)系,按(an)年度(du)(du)監測(ce)并發(fa)(fa)(fa)(fa)布市場和(he)產(chan)業(ye)(ye)發(fa)(fa)(fa)(fa)展(zhan)(zhan)情況,分(fen)綠(lv)色、橙色和(he)紅色三個等級為(wei)(wei)行(xing)(xing)業(ye)(ye)提供(gong)信息(xi)和(he)預警。電(dian)(dian)(dian)(dian)(dian)網(wang)企業(ye)(ye)充分(fen)發(fa)(fa)(fa)(fa)揮資源(yuan)優(you)化配置平(ping)臺(tai)作用(yong),優(you)化調度(du)(du)運行(xing)(xing),加快輸電(dian)(dian)(dian)(dian)(dian)通道建設(she),支持(chi)(chi)可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)高(gao)比例運行(xing)(xing)和(he)大(da)規模外送(song)。經過各方(fang)面共同努力,可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)棄(qi)電(dian)(dian)(dian)(dian)(dian)狀況持(chi)(chi)續緩解。2016年全(quan)國平(ping)均棄(qi)風(feng)(feng)率(lv)(lv)為(wei)(wei)17%,棄(qi)光(guang)率(lv)(lv)為(wei)(wei)10%;2019年1—9月,全(quan)國平(ping)均棄(qi)風(feng)(feng)率(lv)(lv)降至4.2%,棄(qi)光(guang)率(lv)(lv)降至1.9%。青海創新開展(zhan)(zhan)“綠(lv)電(dian)(dian)(dian)(dian)(dian)15日”創造了(le)全(quan)球(qiu)清潔能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)供(gong)電(dian)(dian)(dian)(dian)(dian)紀錄(lu)。國家(jia)(jia)發(fa)(fa)(fa)(fa)展(zhan)(zhan)改革(ge)(ge)委、能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)局(ju)大(da)力推(tui)動分(fen)布式(shi)發(fa)(fa)(fa)(fa)電(dian)(dian)(dian)(dian)(dian)應用(yong),截(jie)至2018年底,分(fen)布式(shi)光(guang)伏(fu)累計并網(wang)裝機(ji)容量達5061萬(wan)千瓦,成為(wei)(wei)光(guang)伏(fu)產(chan)業(ye)(ye)新增長(chang)點。農業(ye)(ye)農村部(bu)等有關(guan)部(bu)門(men)和(he)地區積極(ji)實施(shi)農村沼氣(qi)轉型升級,發(fa)(fa)(fa)(fa)展(zhan)(zhan)秸稈能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)化利(li)用(yong),目(mu)前全(quan)國秸稈成型燃料年產(chan)量達到800萬(wan)噸。生(sheng)(sheng)(sheng)(sheng)態(tai)環境部(bu)將(jiang)可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)項目(mu)納(na)(na)(na)入溫室氣(qi)體(ti)自愿減排(pai)交易體(ti)系重點支持(chi)(chi)領域(yu),將(jiang)發(fa)(fa)(fa)(fa)展(zhan)(zhan)可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)作為(wei)(wei)實現碳強(qiang)度(du)(du)降低(di)目(mu)標的(de)有效路徑,不(bu)斷推(tui)動可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)高(gao)質量開發(fa)(fa)(fa)(fa)利(li)用(yong)。同時(shi),一些地方(fang)將(jiang)可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)發(fa)(fa)(fa)(fa)展(zhan)(zhan)與促進民生(sheng)(sheng)(sheng)(sheng)改善、助力脫貧攻堅、解決無電(dian)(dian)(dian)(dian)(dian)地區用(yong)電(dian)(dian)(dian)(dian)(dian)相結合,因地制宜探索光(guang)伏(fu)+農業(ye)(ye)、光(guang)伏(fu)+漁(yu)業(ye)(ye)、風(feng)(feng)光(guang)互補開發(fa)(fa)(fa)(fa),開展(zhan)(zhan)風(feng)(feng)電(dian)(dian)(dian)(dian)(dian)清潔供(gong)暖、可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)微電(dian)(dian)(dian)(dian)(dian)網(wang)等示范項目(mu)建設(she),可(ke)(ke)(ke)再(zai)(zai)生(sheng)(sheng)(sheng)(sheng)能(neng)(neng)(neng)(neng)(neng)(neng)源(yuan)發(fa)(fa)(fa)(fa)展(zhan)(zhan)的(de)綜合效益(yi)逐步顯現。
(五)注重經濟激勵,為可再生能源發展提供財政支持
法(fa)律(lv)第5章(zhang)、第6章(zhang)明(ming)確(que)了可(ke)(ke)再(zai)生(sheng)能(neng)(neng)源經(jing)濟調(diao)控有關法(fa)律(lv)制度,包括(kuo)分(fen)類電(dian)(dian)價、發展(zhan)基金(jin)(jin)、財(cai)稅(shui)(shui)(shui)政策(ce)等。國務院相關部門按(an)照有利于促(cu)進可(ke)(ke)再(zai)生(sheng)能(neng)(neng)源開發利用(yong)和(he)經(jing)濟合理(li)的原則,制定(ding)了基于固定(ding)電(dian)(dian)價下的補(bu)(bu)貼政策(ce),明(ming)確(que)上網電(dian)(dian)價高于煤電(dian)(dian)標桿電(dian)(dian)價的部分(fen)通過可(ke)(ke)再(zai)生(sheng)能(neng)(neng)源發展(zhan)基金(jin)(jin)補(bu)(bu)償。2019年(nian)將上網標桿電(dian)(dian)價調(diao)整為(wei)指導價,新增(zeng)項(xiang)目上網電(dian)(dian)價通過競(jing)爭方(fang)式確(que)定(ding)。同時電(dian)(dian)價附(fu)加(jia)征收標準逐步提(ti)高,由初期每(mei)(mei)度電(dian)(dian)0.1分(fen)調(diao)整為(wei)2016年(nian)每(mei)(mei)度電(dian)(dian)1.9分(fen)。財(cai)政部設立(li)專項(xiang)資金(jin)(jin),累計撥付1312億(yi)元(yuan)支(zhi)持可(ke)(ke)再(zai)生(sheng)能(neng)(neng)源產業化規(gui)模應用(yong),支(zhi)持解決(jue)無電(dian)(dian)地區用(yong)電(dian)(dian)問題等。據財(cai)政部統計,2012年(nian)以來累計安排(pai)補(bu)(bu)貼資金(jin)(jin)超過4500億(yi)元(yuan),為(wei)可(ke)(ke)再(zai)生(sheng)能(neng)(neng)源快速發展(zhan)提(ti)供了有力(li)支(zhi)持。在稅(shui)(shui)(shui)收方(fang)面(mian),積極落(luo)實國家重點扶持的公共基礎設施項(xiang)目企業所得稅(shui)(shui)(shui)三免三減半、風電(dian)(dian)增(zeng)值稅(shui)(shui)(shui)即征即退50%、固定(ding)資產加(jia)速折舊等優惠(hui)政策(ce),下調(diao)增(zeng)值稅(shui)(shui)(shui)稅(shui)(shui)(shui)率,可(ke)(ke)再(zai)生(sheng)能(neng)(neng)源相關企業普遍受益。
三、存在的主要問題
隨著可(ke)再(zai)生(sheng)能(neng)源技(ji)術(shu)進步和(he)產業快(kuai)速發展(zhan),我國可(ke)再(zai)生(sheng)能(neng)源進入全(quan)面、快(kuai)速、規(gui)模化發展(zhan)階段,可(ke)再(zai)生(sheng)能(neng)源法一(yi)些制度規(gui)定在實施中存在相互間不(bu)夠協(xie)調、執行(xing)不(bu)夠到位(wei)等問題,需要中央(yang)和(he)地方、政府和(he)企業統籌(chou)解決。
(一)相關規劃尚未充分銜接
法(fa)律第(di)8條規(gui)(gui)(gui)(gui)(gui)定(ding),省、自治(zhi)區、直(zhi)轄市人民(min)政府(fu)管理(li)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)工作的(de)部門會同本(ben)級(ji)(ji)人民(min)政府(fu)有(you)關(guan)部門,依(yi)據(ju)全(quan)國可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)開(kai)發(fa)利(li)(li)用(yong)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)和(he)本(ben)行(xing)政區域(yu)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)開(kai)發(fa)利(li)(li)用(yong)中(zhong)長期目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao),編制(zhi)本(ben)行(xing)政區域(yu)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)開(kai)發(fa)利(li)(li)用(yong)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)。法(fa)律第(di)9條規(gui)(gui)(gui)(gui)(gui)定(ding),可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)內(nei)容應當包括發(fa)展(zhan)目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao)、主要任(ren)務(wu)、區域(yu)布(bu)局(ju)(ju)、重(zhong)點項目(mu)(mu)(mu)(mu)(mu)、實施進度、配套電(dian)網(wang)建(jian)設、服務(wu)體(ti)(ti)系和(he)保障措施等。具體(ti)(ti)實施中(zhong)存(cun)在相關(guan)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)不(bu)(bu)(bu)夠(gou)銜(xian)接(jie)、執行(xing)不(bu)(bu)(bu)夠(gou)到(dao)位等問題。一(yi)是(shi)各級(ji)(ji)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)不(bu)(bu)(bu)夠(gou)銜(xian)接(jie)。檢(jian)查中(zhong)發(fa)現,國家(jia)(jia)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)發(fa)展(zhan)目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao)和(he)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)缺乏約束性,一(yi)些地(di)方(fang)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)開(kai)發(fa)利(li)(li)用(yong)中(zhong)長期總(zong)量目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao)未嚴格依(yi)照全(quan)國總(zong)量目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao)確(que)定(ding),地(di)方(fang)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)發(fa)展(zhan)目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao)超過上級(ji)(ji)總(zong)體(ti)(ti)目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao),建(jian)設規(gui)(gui)(gui)(gui)(gui)模、布(bu)局(ju)(ju)和(he)速度也與(yu)上級(ji)(ji)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)不(bu)(bu)(bu)一(yi)致(zhi)。如國家(jia)(jia)“十三(san)(san)五(wu)”規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)中(zhong)確(que)定(ding)新疆風電(dian)發(fa)展(zhan)目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao)為(wei)1800萬(wan)千(qian)瓦,而新疆可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)“十三(san)(san)五(wu)”規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)中(zhong)確(que)定(ding)風電(dian)發(fa)展(zhan)目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao)為(wei)3650萬(wan)千(qian)瓦,遠(yuan)超國家(jia)(jia)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)目(mu)(mu)(mu)(mu)(mu)標(biao)(biao)(biao)。二是(shi)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)開(kai)發(fa)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)與(yu)電(dian)網(wang)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)實施中(zhong)缺乏銜(xian)接(jie)。一(yi)些地(di)方(fang)反映,電(dian)網(wang)規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)建(jian)設與(yu)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)開(kai)發(fa)利(li)(li)用(yong)不(bu)(bu)(bu)適應,電(dian)網(wang)建(jian)設滯后于可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)發(fa)展(zhan),輸(shu)電(dian)通道不(bu)(bu)(bu)足(zu),且部分輸(shu)電(dian)通道能(neng)(neng)(neng)(neng)力未達(da)到(dao)設計水平(ping),可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)電(dian)力輸(shu)出受(shou)阻問題比較明顯。如我(wo)國“三(san)(san)北”地(di)區新能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)裝機(ji)達(da)到(dao)2.3億千(qian)瓦,本(ben)地(di)市場有(you)限,跨區外(wai)送(song)能(neng)(neng)(neng)(neng)力只有(you)4200萬(wan)千(qian)瓦,僅占新能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)裝機(ji)的(de)18%。靈活性電(dian)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)比例(li)不(bu)(bu)(bu)盡合理(li),蓄能(neng)(neng)(neng)(neng)電(dian)站規(gui)(gui)(gui)(gui)(gui)劃(hua)(hua)建(jian)設較為(wei)滯后,影(ying)響電(dian)網(wang)穩定(ding)性,不(bu)(bu)(bu)利(li)(li)于可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)(yuan)(yuan)消(xiao)納。
(二)可再生能源消納壓力仍然較大
法(fa)律第13條規定,國(guo)家(jia)鼓勵和支持(chi)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)并網(wang)發(fa)(fa)電(dian)(dian)(dian)。檢(jian)查中發(fa)(fa)現,受多種(zhong)因素影響,一些(xie)(xie)局部(bu)地區(qu)(qu)棄(qi)電(dian)(dian)(dian)率仍然偏高(gao),可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)消(xiao)納(na)問(wen)題仍需重(zhong)視。“十(shi)二五”以來,我(wo)國(guo)包括可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)在內(nei)的(de)各類電(dian)(dian)(dian)源(yuan)(yuan)(yuan)保持(chi)快速增(zeng)長(chang),而用電(dian)(dian)(dian)需求不(bu)夠平衡,消(xiao)納(na)市(shi)場容量不(bu)足。可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)富(fu)(fu)集區(qu)(qu)與(yu)(yu)(yu)用電(dian)(dian)(dian)負(fu)(fu)荷區(qu)(qu)不(bu)匹配(pei),一些(xie)(xie)地方出(chu)于利益考慮(lv)不(bu)優先(xian)接受外來電(dian)(dian)(dian)力(li)(li),行政(zheng)區(qu)(qu)域間壁(bi)壘(lei)嚴重(zhong),可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)異(yi)地消(xiao)納(na)矛(mao)盾較(jiao)為突出(chu)。同時,我(wo)國(guo)電(dian)(dian)(dian)源(yuan)(yuan)(yuan)結(jie)構性(xing)矛(mao)盾突出(chu),缺少抽水蓄能(neng)(neng)(neng)等靈活調節電(dian)(dian)(dian)源(yuan)(yuan)(yuan)與(yu)(yu)(yu)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)匹配(pei),特(te)(te)別是(shi)在冬季(ji)供(gong)暖期,煤電(dian)(dian)(dian)機(ji)組熱(re)電(dian)(dian)(dian)聯產與(yu)(yu)(yu)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)電(dian)(dian)(dian)力(li)(li)消(xiao)納(na)矛(mao)盾更(geng)加突出(chu)。如吉林裝機(ji)容量是(shi)用電(dian)(dian)(dian)負(fu)(fu)荷的(de)2.6—5.8倍,省內(nei)電(dian)(dian)(dian)源(yuan)(yuan)(yuan)持(chi)續富(fu)(fu)余,特(te)(te)別是(shi)在冬季(ji)供(gong)暖期,保證供(gong)熱(re)的(de)火(huo)電(dian)(dian)(dian)最小發(fa)(fa)電(dian)(dian)(dian)出(chu)力(li)(li)比低(di)谷用電(dian)(dian)(dian)負(fu)(fu)荷高(gao)210—320萬千瓦,電(dian)(dian)(dian)網(wang)調峰困難。由于一些(xie)(xie)可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)資源(yuan)(yuan)(yuan)富(fu)(fu)集的(de)重(zhong)點地區(qu)(qu)缺乏針對性(xing)政(zheng)策(ce)安排(pai),可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)電(dian)(dian)(dian)力(li)(li)消(xiao)納(na)壓力(li)(li)很(hen)大(da),一定程度影響和制約(yue)了可(ke)(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)的(de)健康快速發(fa)(fa)展。
(三)全額保障性收購制度落實尚不到位
法律(lv)第14條規定,國(guo)家(jia)實(shi)行可再(zai)生(sheng)能源發(fa)(fa)(fa)電全額保障(zhang)(zhang)性收購制(zhi)(zhi)度。檢查中(zhong)發(fa)(fa)(fa)現,個別(bie)(bie)省份暫未達到國(guo)家(jia)規定的最(zui)低(di)(di)保障(zhang)(zhang)收購年(nian)利(li)用小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)數(shu),且存在以低(di)(di)于(yu)國(guo)家(jia)有關(guan)政(zheng)策(ce)明確(que)的電價水平收購的情(qing)況。如(ru)寧夏2018年(nian)自行制(zhi)(zhi)定風電最(zui)低(di)(di)保障(zhang)(zhang)性收購利(li)用小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)數(shu)為750—850小(xiao)(xiao)(xiao)(xiao)時(shi)(shi),遠(yuan)低(di)(di)于(yu)國(guo)家(jia)核定的1850小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)最(zui)低(di)(di)保障(zhang)(zhang)收購小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)數(shu)。甘肅2018年(nian)自行設置(zhi)的風電、光(guang)伏發(fa)(fa)(fa)電保障(zhang)(zhang)性收購小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)數(shu)分別(bie)(bie)為774小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)和479小(xiao)(xiao)(xiao)(xiao)時(shi)(shi),距國(guo)家(jia)保障(zhang)(zhang)性收購政(zheng)策(ce)規定的風電1800小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)和光(guang)伏發(fa)(fa)(fa)電1500小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)差距較大;實(shi)際風電、光(guang)伏發(fa)(fa)(fa)電利(li)用小(xiao)(xiao)(xiao)(xiao)時(shi)(shi)數(shu)中(zhong),大部分電量屬于(yu)低(di)(di)價市(shi)場化交易(yi),發(fa)(fa)(fa)電企業合法權益(yi)保障(zhang)(zhang)不足(zu)。
(四)電價補償和發展基金問題較為突出
法(fa)律第(di)(di)20條規(gui)(gui)定,收(shou)(shou)購可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)量(liang)所(suo)發(fa)(fa)(fa)生(sheng)的費(fei)用(yong),高(gao)(gao)于按(an)照常(chang)規(gui)(gui)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)發(fa)(fa)(fa)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)平均(jun)上(shang)(shang)網(wang)(wang)(wang)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)計算(suan)所(suo)發(fa)(fa)(fa)生(sheng)費(fei)用(yong)之間的差額,由在全國(guo)(guo)(guo)范圍對銷售電(dian)(dian)(dian)(dian)(dian)(dian)(dian)量(liang)征(zheng)(zheng)(zheng)收(shou)(shou)可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)附(fu)加(jia)(jia)(jia)(jia)(jia)補(bu)(bu)償(chang)。法(fa)律第(di)(di)24條規(gui)(gui)定,國(guo)(guo)(guo)家財政(zheng)(zheng)設立(li)可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)發(fa)(fa)(fa)展(zhan)(zhan)(zhan)基金,資(zi)金來源(yuan)(yuan)(yuan)(yuan)包括國(guo)(guo)(guo)家財政(zheng)(zheng)年度安排(pai)的專項(xiang)(xiang)(xiang)資(zi)金和依(yi)法(fa)征(zheng)(zheng)(zheng)收(shou)(shou)的可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)附(fu)加(jia)(jia)(jia)(jia)(jia)收(shou)(shou)入等。檢查(cha)中各地反映,電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)補(bu)(bu)償(chang)政(zheng)(zheng)策落(luo)(luo)實(shi)不到(dao)位,補(bu)(bu)貼(tie)(tie)資(zi)金來源(yuan)(yuan)(yuan)(yuan)不足(zu),補(bu)(bu)貼(tie)(tie)發(fa)(fa)(fa)放不及(ji)時(shi),影響企業正常(chang)經營(ying)和發(fa)(fa)(fa)展(zhan)(zhan)(zhan)。國(guo)(guo)(guo)家相(xiang)關部(bu)門反映,現行可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)發(fa)(fa)(fa)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)補(bu)(bu)貼(tie)(tie)政(zheng)(zheng)策已遠(yuan)不能(neng)(neng)(neng)滿足(zu)可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)發(fa)(fa)(fa)展(zhan)(zhan)(zhan)需(xu)要(yao)。目前征(zheng)(zheng)(zheng)收(shou)(shou)總額僅能(neng)(neng)(neng)滿足(zu)2015年底前已并網(wang)(wang)(wang)項(xiang)(xiang)(xiang)目的補(bu)(bu)貼(tie)(tie)需(xu)求,“十三五”期間90%以上(shang)(shang)新增可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)發(fa)(fa)(fa)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)項(xiang)(xiang)(xiang)目補(bu)(bu)貼(tie)(tie)資(zi)金來源(yuan)(yuan)(yuan)(yuan)尚未落(luo)(luo)實(shi)。一是可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)附(fu)加(jia)(jia)(jia)(jia)(jia)未及(ji)時(shi)調整(zheng)。2016年可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)附(fu)加(jia)(jia)(jia)(jia)(jia)征(zheng)(zheng)(zheng)收(shou)(shou)標(biao)準提高(gao)(gao)到(dao)每千瓦時(shi)1.9分(fen),后期未作(zuo)調整(zheng),其他資(zi)金來源(yuan)(yuan)(yuan)(yuan)不足(zu),補(bu)(bu)償(chang)缺(que)口逐步擴大。二是電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)附(fu)加(jia)(jia)(jia)(jia)(jia)未依(yi)法(fa)嚴格征(zheng)(zheng)(zheng)收(shou)(shou)。第(di)(di)三方(fang)評估報告指(zhi)出,2015—2018年可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)平均(jun)附(fu)加(jia)(jia)(jia)(jia)(jia)征(zheng)(zheng)(zheng)收(shou)(shou)率僅為84.4%。各地方(fang)廣泛存在著(zhu)只對公共電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)工商業用(yong)戶征(zheng)(zheng)(zheng)收(shou)(shou),對自備電(dian)(dian)(dian)(dian)(dian)(dian)(dian)廠用(yong)戶、地方(fang)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)網(wang)(wang)(wang)用(yong)電(dian)(dian)(dian)(dian)(dian)(dian)(dian)長期未征(zheng)(zheng)(zheng)、少征(zheng)(zheng)(zheng)等問題。三是發(fa)(fa)(fa)展(zhan)(zhan)(zhan)規(gui)(gui)模(mo)缺(que)乏有效控制。可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)發(fa)(fa)(fa)展(zhan)(zhan)(zhan)初期,電(dian)(dian)(dian)(dian)(dian)(dian)(dian)價(jia)(jia)調整(zheng)滯后于技術(shu)發(fa)(fa)(fa)展(zhan)(zhan)(zhan)水平,部(bu)分(fen)可(ke)(ke)(ke)再(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)(yuan)企業追求高(gao)(gao)投資(zi)回(hui)報,非理性投資(zi),搶(qiang)裝機(ji)、搶(qiang)上(shang)(shang)網(wang)(wang)(wang)問題突出,一些(xie)地方(fang)未按(an)照國(guo)(guo)(guo)家規(gui)(gui)劃有效控制本地區發(fa)(fa)(fa)展(zhan)(zhan)(zhan)規(gui)(gui)模(mo),加(jia)(jia)(jia)(jia)(jia)劇了(le)補(bu)(bu)貼(tie)(tie)缺(que)口。
(五)與相關財稅、土地、環保等政策銜接不夠
法律第25、26條分別規(gui)(gui)定(ding),對(dui)列入(ru)國(guo)家(jia)(jia)可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)產(chan)業(ye)發(fa)(fa)(fa)展(zhan)指導(dao)目錄的(de)(de)(de)有關(guan)項目,金融(rong)機構對(dui)其提(ti)供優(you)惠(hui)(hui)貸(dai)(dai)款,國(guo)家(jia)(jia)給予稅收(shou)(shou)優(you)惠(hui)(hui)。檢查(cha)中一些企業(ye)反(fan)映,可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)企業(ye)特別是(shi)(shi)民營企業(ye)貸(dai)(dai)款難(nan)、貸(dai)(dai)款貴(gui)問(wen)題仍然存在(zai)。第三(san)方(fang)評估報告指出,財政(zheng)(zheng)貼(tie)息政(zheng)(zheng)策(ce)沒有落實(shi),優(you)惠(hui)(hui)貸(dai)(dai)款政(zheng)(zheng)策(ce)未覆蓋可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)領域(yu)。一些地(di)(di)方(fang)反(fan)映,可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)開(kai)發(fa)(fa)(fa)利用與土(tu)地(di)(di)管理、生(sheng)態(tai)(tai)環(huan)(huan)境(jing)保護等(deng)政(zheng)(zheng)策(ce)銜接(jie)不(bu)(bu)夠,相(xiang)(xiang)關(guan)部門監管協同不(bu)(bu)夠,可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)建(jian)設布局、開(kai)發(fa)(fa)(fa)規(gui)(gui)模受(shou)政(zheng)(zheng)策(ce)調整影響較大。河北是(shi)(shi)京津冀重要(yao)(yao)的(de)(de)(de)生(sheng)態(tai)(tai)環(huan)(huan)境(jing)支撐區,青海自(zi)然生(sheng)態(tai)(tai)系(xi)統(tong)敏(min)感脆弱,可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)開(kai)發(fa)(fa)(fa)利用更要(yao)(yao)重視(shi)與資(zi)源(yuan)環(huan)(huan)境(jing)相(xiang)(xiang)關(guan)政(zheng)(zheng)策(ce)的(de)(de)(de)銜接(jie),可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)綠(lv)色高質量發(fa)(fa)(fa)展(zhan)任務艱巨。企業(ye)反(fan)映,有的(de)(de)(de)地(di)(di)方(fang)土(tu)地(di)(di)稅費征收(shou)(shou)不(bu)(bu)規(gui)(gui)范(fan),稅收(shou)(shou)減(jian)免措施落實(shi)不(bu)(bu)到位,造成非技術成本高昂。另外(wai),現行政(zheng)(zheng)策(ce)對(dui)可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)開(kai)發(fa)(fa)(fa)利用全(quan)生(sheng)命周期(qi)(qi)生(sheng)態(tai)(tai)環(huan)(huan)境(jing)效益(yi)考慮不(bu)(bu)足(zu),重視(shi)前期(qi)(qi)開(kai)發(fa)(fa)(fa)利用,忽視(shi)產(chan)品(pin)末端回收(shou)(shou)。風力(li)發(fa)(fa)(fa)電機壽(shou)命為(wei)20年左(zuo)右(you)(you),太陽能(neng)(neng)(neng)(neng)板使用壽(shou)命為(wei)25年左(zuo)右(you)(you),早期(qi)(qi)投(tou)產(chan)的(de)(de)(de)可再生(sheng)能(neng)(neng)(neng)(neng)源(yuan)設備陸續進入(ru)報廢期(qi)(qi),廢棄物回收(shou)(shou)處理處置(zhi)需要(yao)(yao)規(gui)(gui)范(fan)管理。
(六)可再生能源非電應用支持政策存在短板
法(fa)律第16、17條明(ming)確國家(jia)鼓勵發展(zhan)生(sheng)物質(zhi)燃(ran)氣和熱(re)力(li)(li)、太陽能(neng)(neng)熱(re)利(li)用(yong)等(deng)。實際工作中,各類型可(ke)再(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)之(zhi)間發展(zhan)不(bu)平衡,可(ke)再(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)非電(dian)應(ying)用(yong)明(ming)顯滯后于(yu)發電(dian)類項目,太陽能(neng)(neng)熱(re)利(li)用(yong)、地熱(re)利(li)用(yong)以(yi)及生(sheng)物質(zhi)燃(ran)料的(de)發展(zhan)都較(jiao)為緩(huan)慢。企(qi)業反(fan)映,可(ke)再(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)非電(dian)應(ying)用(yong)政(zheng)策(ce)支持(chi)和經濟(ji)激勵力(li)(li)度不(bu)足,生(sheng)物質(zhi)熱(re)力(li)(li)、生(sheng)物燃(ran)氣、生(sheng)物柴油等(deng)產品缺乏(fa)具體的(de)支持(chi)政(zheng)策(ce),受(shou)特許經營限制(zhi),難(nan)以(yi)公平進入市場。生(sheng)物質(zhi)能(neng)(neng)開發利(li)用(yong)對于(yu)改善民生(sheng)、助力(li)(li)脫貧攻堅、保(bao)護生(sheng)態環(huan)境等(deng)具有(you)更加直(zhi)接的(de)作用(yong),應(ying)統(tong)籌考慮其環(huan)保(bao)效益和社會效益,加大財(cai)稅(shui)政(zheng)策(ce)支持(chi)力(li)(li)度。另外,一(yi)些地方反(fan)映對可(ke)再(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)用(yong)戶(hu)企(qi)業支持(chi)政(zheng)策(ce)尚有(you)不(bu)足。
(七)可再生能源技術研發應用仍需加強
法律第12條規定,支持推動可再生(sheng)(sheng)能(neng)源開發(fa)利用的(de)科學技(ji)(ji)(ji)術(shu)研究、應用示范和產業化(hua)發(fa)展。雖然(ran)我國(guo)可再生(sheng)(sheng)能(neng)源技(ji)(ji)(ji)術(shu)水平(ping)(ping)取得顯(xian)著進步,但在(zai)技(ji)(ji)(ji)術(shu)研發(fa)能(neng)力、裝備制造質量、工程技(ji)(ji)(ji)術(shu)創新、公共(gong)技(ji)(ji)(ji)術(shu)體系建設方面仍需(xu)進一步加強。一是(shi)(shi)部分核心(xin)技(ji)(ji)(ji)術(shu)研發(fa)能(neng)力偏弱(ruo)。大容(rong)量儲(chu)能(neng)技(ji)(ji)(ji)術(shu)尚存在(zai)技(ji)(ji)(ji)術(shu)瓶頸(jing),安全經濟的(de)新型儲(chu)能(neng)產品有(you)待(dai)突(tu)破。風電機組軸承國(guo)產化(hua)程度不高(gao),風電機組控(kong)制機組核心(xin)元器(qi)件、部分高(gao)效(xiao)光伏電池生(sheng)(sheng)產裝備主(zhu)要依賴進口。二(er)是(shi)(shi)電網接入和運(yun)行(xing)技(ji)(ji)(ji)術(shu)有(you)待(dai)快速提(ti)升。電網運(yun)行(xing)控(kong)制技(ji)(ji)(ji)術(shu)、智(zhi)能(neng)化(hua)水平(ping)(ping)、靈(ling)活調節能(neng)力以及新能(neng)源功率(lv)預測(ce)技(ji)(ji)(ji)術(shu)等(deng),均需(xu)要提(ti)升到適應高(gao)比例可再生(sheng)(sheng)能(neng)源并網運(yun)行(xing)水平(ping)(ping)。三是(shi)(shi)生(sheng)(sheng)物質能(neng)相關技(ji)(ji)(ji)術(shu)有(you)待(dai)突(tu)破。成型燃(ran)料、生(sheng)(sheng)物燃(ran)料乙醇、生(sheng)(sheng)物質氣化(hua)等(deng)存在(zai)技(ji)(ji)(ji)術(shu)瓶頸(jing)。四是(shi)(shi)可再生(sheng)(sheng)能(neng)源標準化(hua)建設、開發(fa)利用裝備公共(gong)檢(jian)測(ce)試(shi)驗能(neng)力有(you)待(dai)提(ti)升。
(八)可再生能源行業監管力度不夠
可(ke)再生能源法(fa)(fa)規定了(le)各級政府部門、相關企業的權利義務,具體實施中由于相關責任(ren)(ren)主體不夠明確(que)、缺(que)乏有(you)力(li)監管等(deng)原因,造成對執行不到位(wei)的難以(yi)實施處罰(fa)。法(fa)(fa)律(lv)(lv)第28—31條(tiao)規定了(le)相關部門、電(dian)網企業、燃氣和熱力(li)管網企業、石油銷(xiao)售企業的法(fa)(fa)律(lv)(lv)責任(ren)(ren),但自(zi)法(fa)(fa)律(lv)(lv)頒布(bu)實施以(yi)來(lai),尚未(wei)有(you)因違反(fan)可(ke)再生能源法(fa)(fa)獲得(de)相關行政處罰(fa)的案例發生,法(fa)(fa)律(lv)(lv)責任(ren)(ren)條(tiao)款(kuan)并未(wei)有(you)效落實。
四、意見和建議
各(ge)地各(ge)部門要(yao)以習(xi)近(jin)(jin)平新時代中國特色社會(hui)(hui)主義思想(xiang)為指導(dao),認真貫(guan)(guan)徹落實習(xi)近(jin)(jin)平生(sheng)態(tai)文(wen)明思想(xiang),貫(guan)(guan)徹落實習(xi)近(jin)(jin)平總書記關于(yu)能(neng)(neng)源(yuan)(yuan)(yuan)生(sheng)產和(he)消(xiao)(xiao)費革命的重(zhong)要(yao)論(lun)述,以及中央十九屆四(si)中全會(hui)(hui)有關“推進能(neng)(neng)源(yuan)(yuan)(yuan)革命,構建清(qing)潔低碳、安全高效(xiao)的能(neng)(neng)源(yuan)(yuan)(yuan)體系(xi)”戰(zhan)略(lve)部署,全面推動可(ke)(ke)(ke)(ke)(ke)再(zai)(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)高質(zhi)量(liang)發(fa)展。要(yao)從能(neng)(neng)源(yuan)(yuan)(yuan)革命戰(zhan)略(lve)高度考慮可(ke)(ke)(ke)(ke)(ke)再(zai)(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)發(fa)展問(wen)題,重(zhong)視可(ke)(ke)(ke)(ke)(ke)再(zai)(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)發(fa)展在(zai)整(zheng)個(ge)經濟社會(hui)(hui)發(fa)展中的戰(zhan)略(lve)地位,統籌處理(li)好可(ke)(ke)(ke)(ke)(ke)再(zai)(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)與(yu)(yu)化石(shi)能(neng)(neng)源(yuan)(yuan)(yuan)的關系(xi),處理(li)好可(ke)(ke)(ke)(ke)(ke)再(zai)(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)開發(fa)利(li)用(yong)與(yu)(yu)并網(wang)消(xiao)(xiao)納的關系(xi)。要(yao)堅持(chi)清(qing)潔低碳、綠色發(fa)展,保持(chi)優先發(fa)展可(ke)(ke)(ke)(ke)(ke)再(zai)(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)的定(ding)力不動搖(yao),提高可(ke)(ke)(ke)(ke)(ke)再(zai)(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)消(xiao)(xiao)費比(bi)重(zhong),努力盡早實現到(dao)2030年非(fei)化石(shi)能(neng)(neng)源(yuan)(yuan)(yuan)占一次能(neng)(neng)源(yuan)(yuan)(yuan)消(xiao)(xiao)費比(bi)重(zhong)達到(dao)20%的目標。
(一)做好頂層設計,提高規劃的科學性和協調性

(二)完善體制機制,統籌解決可再生能源消納問題
國務院相(xiang)關部門(men)要加(jia)快建(jian)立(li)統一協調的(de)體(ti)(ti)制機制,加(jia)強溝(gou)通銜(xian)接,共同研究和(he)統籌處理好可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)開發和(he)消(xiao)(xiao)納(na)(na)利(li)(li)用的(de)關系,進一步提高可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)利(li)(li)用率。結(jie)(jie)合電(dian)(dian)力(li)體(ti)(ti)制改革,抓緊研究有利(li)(li)于可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)大(da)規模(mo)并網的(de)電(dian)(dian)力(li)運行體(ti)(ti)制和(he)機制,完善(shan)以可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)利(li)(li)用指(zhi)標為導(dao)向的(de)能(neng)(neng)(neng)源(yuan)(yuan)發展指(zhi)標考核(he)體(ti)(ti)系。結(jie)(jie)合北(bei)方(fang)冬季清(qing)潔取暖(nuan)等(deng)相(xiang)關政策(ce)推進實施,鼓勵(li)分布式可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)自(zi)發自(zi)用,促(cu)進就地(di)消(xiao)(xiao)納(na)(na)利(li)(li)用。完善(shan)可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)電(dian)(dian)力(li)市(shi)場(chang)(chang)交易機制,打(da)破省間電(dian)(dian)力(li)交易壁壘,鼓勵(li)送受兩端(duan)市(shi)場(chang)(chang)主體(ti)(ti)直(zhi)接開展交易,有針對性地(di)建(jian)立(li)可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)發電(dian)(dian)參與電(dian)(dian)力(li)現貨市(shi)場(chang)(chang)交易的(de)體(ti)(ti)系。積極引(yin)導(dao)和(he)規范(fan)電(dian)(dian)力(li)市(shi)場(chang)(chang)建(jian)設,通過市(shi)場(chang)(chang)化方(fang)式提升可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)消(xiao)(xiao)納(na)(na)能(neng)(neng)(neng)力(li)。電(dian)(dian)網公司(si)應(ying)加(jia)強輸(shu)電(dian)(dian)通道建(jian)設,提高可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)電(dian)(dian)力(li)跨區(qu)域輸(shu)送能(neng)(neng)(neng)力(li)。
(三)加強統籌協調,綜合研究解決補貼資金拖欠問題
國家發(fa)展改革、財(cai)政(zheng)(zheng)、能(neng)(neng)(neng)(neng)源(yuan)等(deng)部門要進一(yi)步完(wan)善(shan)可再(zai)生(sheng)(sheng)能(neng)(neng)(neng)(neng)源(yuan)價格補(bu)(bu)貼(tie)政(zheng)(zheng)策(ce),保持相關(guan)政(zheng)(zheng)策(ce)的(de)(de)(de)科學性和連續性,合理確定電價附(fu)加(jia)征收(shou)標準動態調整和補(bu)(bu)貼(tie)退坡有關(guan)政(zheng)(zheng)策(ce)的(de)(de)(de)調整方向(xiang)、節奏等(deng),穩定企(qi)(qi)(qi)(qi)業(ye)(ye)預期。要統籌考慮政(zheng)(zheng)府財(cai)政(zheng)(zheng)支撐(cheng)能(neng)(neng)(neng)(neng)力、環境保護和改善(shan)民生(sheng)(sheng)需(xu)求等(deng)多(duo)方面因素,開拓思(si)路提出解(jie)決(jue)存量項(xiang)目補(bu)(bu)貼(tie)缺口的(de)(de)(de)新辦法,采取(qu)有效措(cuo)施控制新增項(xiang)目補(bu)(bu)貼(tie)需(xu)求。強(qiang)化可再(zai)生(sheng)(sheng)能(neng)(neng)(neng)(neng)源(yuan)電價附(fu)加(jia)征繳,自備電廠應(ying)繳費用(yong)做到應(ying)收(shou)盡收(shou),增加(jia)基金(jin)收(shou)入。鼓(gu)(gu)勵(li)可再(zai)生(sheng)(sheng)能(neng)(neng)(neng)(neng)源(yuan)發(fa)電通過參(can)與電力市場化交易、綠色(se)電力證書交易等(deng)方式減少(shao)補(bu)(bu)貼(tie)需(xu)求,研究出臺(tai)鼓(gu)(gu)勵(li)存量項(xiang)目自愿轉為(wei)平價項(xiang)目的(de)(de)(de)政(zheng)(zheng)策(ce)措(cuo)施。進一(yi)步合理控制新增項(xiang)目開發(fa)規模和建設時序,規范(fan)補(bu)(bu)償范(fan)圍(wei)、優(you)化補(bu)(bu)貼(tie)發(fa)放程序,縮小補(bu)(bu)貼(tie)缺口,逐步實(shi)現收(shou)支平衡。制定鼓(gu)(gu)勵(li)企(qi)(qi)(qi)(qi)業(ye)(ye)自發(fa)自用(yong)可再(zai)生(sheng)(sheng)能(neng)(neng)(neng)(neng)源(yuan)的(de)(de)(de)政(zheng)(zheng)策(ce)。充(chong)分發(fa)揮財(cai)政(zheng)(zheng)資金(jin)的(de)(de)(de)杠桿作(zuo)用(yong),加(jia)大對民營企(qi)(qi)(qi)(qi)業(ye)(ye)和可再(zai)生(sheng)(sheng)能(neng)(neng)(neng)(neng)源(yuan)發(fa)電企(qi)(qi)(qi)(qi)業(ye)(ye)的(de)(de)(de)金(jin)融(rong)支持力度(du)。
(四)健全政策措施,實現可再生能源持續健康發展
根(gen)據不(bu)同(tong)種(zhong)類可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源的(de)(de)發(fa)展(zhan)階段,區別制定發(fa)展(zhan)政(zheng)策,對(dui)產業相(xiang)對(dui)成熟的(de)(de),適當減少政(zheng)策支持(chi)(chi)規模和(he)力(li)度(du)(du),鼓(gu)勵其參(can)與(yu)市場化(hua)競爭;對(dui)有(you)發(fa)展(zhan)潛(qian)力(li)、進(jin)展(zhan)較為(wei)(wei)緩(huan)慢的(de)(de),加大(da)政(zheng)策和(he)財政(zheng)扶持(chi)(chi)。處(chu)理好可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源開(kai)發(fa)利用(yong)(yong)(yong)(yong)同(tong)生(sheng)(sheng)態環境保護的(de)(de)關(guan)系,研(yan)究完善(shan)環境污染防治及廢棄(qi)物(wu)回收處(chu)理相(xiang)關(guan)規定。推(tui)進(jin)抽水蓄能(neng)(neng)(neng)(neng)等(deng)(deng)儲能(neng)(neng)(neng)(neng)電(dian)站建設、加強(qiang)火電(dian)靈(ling)活性改造,提高電(dian)力(li)系統調(diao)峰調(diao)頻能(neng)(neng)(neng)(neng)力(li)。進(jin)一(yi)步完善(shan)分布(bu)式能(neng)(neng)(neng)(neng)源、綜合能(neng)(neng)(neng)(neng)源微(wei)網發(fa)展(zhan)的(de)(de)鼓(gu)勵機(ji)制和(he)政(zheng)策。進(jin)一(yi)步強(qiang)化(hua)生(sheng)(sheng)物(wu)質燃(ran)料、可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源熱利用(yong)(yong)(yong)(yong)等(deng)(deng)可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源非電(dian)應(ying)用(yong)(yong)(yong)(yong)的(de)(de)政(zheng)策支持(chi)(chi),加大(da)資金扶持(chi)(chi)力(li)度(du)(du),完善(shan)配套政(zheng)策及相(xiang)關(guan)規定,在(zai)入(ru)管入(ru)網入(ru)市等(deng)(deng)方面規范標準、簡化(hua)程序,為(wei)(wei)可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源在(zai)各(ge)(ge)個領(ling)域推(tui)廣創(chuang)造條件。嚴格(ge)落(luo)實國家對(dui)可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源開(kai)發(fa)利用(yong)(yong)(yong)(yong)項目的(de)(de)增值稅(shui)、所得稅(shui)、費(fei)用(yong)(yong)(yong)(yong)減免(mian)等(deng)(deng)稅(shui)費(fei)支持(chi)(chi)政(zheng)策,降(jiang)低企(qi)業非技術成本。完善(shan)可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源統計(ji)評價體系,將各(ge)(ge)類可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源利用(yong)(yong)(yong)(yong)情(qing)況(kuang)全部納入(ru)考核指標體系,倒逼可再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源全面發(fa)展(zhan)。
(五)堅持科技創新,推動解決發展中出現的問題
按照(zhao)國(guo)家(jia)能(neng)(neng)(neng)(neng)源發(fa)(fa)展(zhan)整體布局,建立(li)和完(wan)善可(ke)(ke)再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源科(ke)技(ji)(ji)(ji)(ji)(ji)創新(xin)(xin)體系(xi)(xi),提(ti)高(gao)技(ji)(ji)(ji)(ji)(ji)術(shu)創新(xin)(xin)能(neng)(neng)(neng)(neng)力(li)(li)(li)和裝備(bei)制造(zao)水平(ping)。鼓勵(li)企業(ye)(ye)(ye)開(kai)展(zhan)風電(dian)(dian)開(kai)發(fa)(fa)關鍵(jian)技(ji)(ji)(ji)(ji)(ji)術(shu)創新(xin)(xin)攻關,推(tui)(tui)動核心元器件國(guo)產(chan)化(hua)進(jin)(jin)程(cheng),提(ti)升產(chan)品的(de)(de)穩定(ding)性(xing)(xing)和可(ke)(ke)靠性(xing)(xing),加強深海(hai)(hai)、遠(yuan)海(hai)(hai)風電(dian)(dian)開(kai)發(fa)(fa)技(ji)(ji)(ji)(ji)(ji)術(shu)的(de)(de)研(yan)發(fa)(fa)和推(tui)(tui)廣。緊跟世界研(yan)發(fa)(fa)方向和前沿技(ji)(ji)(ji)(ji)(ji)術(shu),探(tan)索(suo)太(tai)陽能(neng)(neng)(neng)(neng)電(dian)(dian)池(chi)低成本制造(zao)、新(xin)(xin)型(xing)電(dian)(dian)池(chi)開(kai)發(fa)(fa)、提(ti)高(gao)電(dian)(dian)池(chi)使用(yong)(yong)壽命等相(xiang)關技(ji)(ji)(ji)(ji)(ji)術(shu)研(yan)發(fa)(fa),適時開(kai)展(zhan)示范,推(tui)(tui)動產(chan)業(ye)(ye)(ye)化(hua)進(jin)(jin)程(cheng)。加快(kuai)(kuai)生(sheng)(sheng)物天然氣和液(ye)體燃料的(de)(de)技(ji)(ji)(ji)(ji)(ji)術(shu)創新(xin)(xin)與(yu)發(fa)(fa)展(zhan),形成產(chan)業(ye)(ye)(ye)的(de)(de)核心設備(bei)研(yan)發(fa)(fa)能(neng)(neng)(neng)(neng)力(li)(li)(li)和檢測(ce)認證體系(xi)(xi),支(zhi)持(chi)推(tui)(tui)進(jin)(jin)相(xiang)關產(chan)業(ye)(ye)(ye)化(hua)進(jin)(jin)程(cheng)。加快(kuai)(kuai)擴大地(di)熱(re)供暖在北(bei)方地(di)區(qu)清潔(jie)取暖中(zhong)的(de)(de)規模和商業(ye)(ye)(ye)化(hua)應(ying)用(yong)(yong),探(tan)索(suo)地(di)熱(re)能(neng)(neng)(neng)(neng)梯級(ji)綜合(he)高(gao)效利用(yong)(yong)技(ji)(ji)(ji)(ji)(ji)術(shu)體系(xi)(xi)和商業(ye)(ye)(ye)模式。加強可(ke)(ke)再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源多能(neng)(neng)(neng)(neng)互補系(xi)(xi)統(tong)集成優化(hua)技(ji)(ji)(ji)(ji)(ji)術(shu)研(yan)究和示范,提(ti)升能(neng)(neng)(neng)(neng)源系(xi)(xi)統(tong)整體效率。推(tui)(tui)動智能(neng)(neng)(neng)(neng)電(dian)(dian)網、柔(rou)性(xing)(xing)直(zhi)流、特高(gao)壓等先進(jin)(jin)輸配電(dian)(dian)技(ji)(ji)(ji)(ji)(ji)術(shu)發(fa)(fa)展(zhan),開(kai)展(zhan)儲(chu)能(neng)(neng)(neng)(neng)、負荷側調(diao)節(jie)等新(xin)(xin)技(ji)(ji)(ji)(ji)(ji)術(shu)應(ying)用(yong)(yong),促進(jin)(jin)高(gao)比例可(ke)(ke)再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源與(yu)電(dian)(dian)力(li)(li)(li)系(xi)(xi)統(tong)融合(he),提(ti)升可(ke)(ke)再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源電(dian)(dian)力(li)(li)(li)的(de)(de)安全可(ke)(ke)靠應(ying)用(yong)(yong)水平(ping)。支(zhi)持(chi)建立(li)可(ke)(ke)再生(sheng)(sheng)能(neng)(neng)(neng)(neng)源技(ji)(ji)(ji)(ji)(ji)術(shu)公(gong)共技(ji)(ji)(ji)(ji)(ji)術(shu)研(yan)發(fa)(fa)平(ping)臺、關鍵(jian)設備(bei)檢測(ce)試驗平(ping)臺,提(ti)高(gao)公(gong)共技(ji)(ji)(ji)(ji)(ji)術(shu)服務能(neng)(neng)(neng)(neng)力(li)(li)(li)和標(biao)準化(hua)水平(ping)。
(六)進一步修改完善可再生能源法
根據推進(jin)(jin)生(sheng)態(tai)文明(ming)(ming)建設(she)和(he)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)結構調整的(de)(de)總體要求(qiu),針對當前可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)發展(zhan)的(de)(de)新形勢、新問題,建議適時啟動(dong)可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)法(fa)修改(gai)。在立法(fa)目(mu)的(de)(de)中充分體現黨中央關于推進(jin)(jin)生(sheng)態(tai)文明(ming)(ming)建設(she)以及(ji)推動(dong)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)生(sheng)產(chan)和(he)消費(fei)革命的(de)(de)戰(zhan)略部署,進(jin)(jin)一步修改(gai)完善可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)全額(e)保障性(xing)收購制(zhi)度(du),綜合考慮經濟技術條件,制(zhi)定(ding)合理(li)的(de)(de)可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)利(li)用(yong)率目(mu)標,明(ming)(ming)確由電(dian)網企(qi)業(ye)(ye)、售電(dian)企(qi)業(ye)(ye)和(he)電(dian)力(li)用(yong)戶共同承擔全額(e)保障性(xing)收購責(ze)任(ren)的(de)(de)法(fa)律定(ding)位。明(ming)(ming)確規定(ding)可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)目(mu)標引導(dao)以及(ji)可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)電(dian)力(li)消納責(ze)任(ren)權重(zhong)考核機制(zhi),形成更加科學合理(li)的(de)(de)目(mu)標責(ze)任(ren)考核體系。適當調整有關電(dian)價補貼的(de)(de)規定(ding),加快(kuai)完善可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)上網電(dian)價市場(chang)化(hua)(hua)形成機制(zhi)。明(ming)(ming)確對脫貧攻堅任(ren)務(wu)重(zhong)、相(xiang)關綜合試點(dian)地區(qu)給予政策優惠等。細化(hua)(hua)支持可(ke)(ke)再(zai)(zai)生(sheng)能(neng)(neng)源(yuan)(yuan)(yuan)(yuan)非電(dian)應用(yong)的(de)(de)規定(ding),加大政策和(he)資金(jin)扶持力(li)度(du)。細化(hua)(hua)相(xiang)關法(fa)律責(ze)任(ren)條款,強(qiang)化(hua)(hua)電(dian)網、石油、燃氣(qi)、熱力(li)等企(qi)業(ye)(ye)的(de)(de)法(fa)律責(ze)任(ren)。
